SO, AS YOU DESCRIBE THE LOCATION AT THE NORTHWEST CORNER OF DOVE ROAD AND 19 OR DAVIS BOULEVARD, IT'S A LITTLE OVER A FIVE-ACRE SITE, AND THE STAR IS THE GENERAL LOCATION OF THE PROPOSED CELL TOWER AND FACILITIES AROUND IT.

THIS IS THE SITE PLAN THAT THEY TURNED IN, AND THE INGRESS EGRESS PORTION COMES RIGHT OFF OF DOVE ROAD ON AN EXISTING ACCESS DRIVE TO THE FIRE STATION.

THE NEXT SLIDE IS A LITTLE BIT BETTER OF A ZOOM IN.

THERE'S A DRIVE THAT'S CONNECTED TO THE FIRE LANE AND ACCESS EASEMENT, AND THE TOWER IS HOUSED WITHIN THE STRUCTURE, STEEPLE STRUCTURE.

AND THEN ADJACENT TO IT IS ANOTHER LEASE BASE.

THIS ONE'S 50 BY 50.

THE ONE ON THE LEFT SIDE IS 25 BY 25.

THERE'S AN EIGHT-FOOT CMU WALL AROUND THE PROPOSED EQUIPMENT WHERE THAT AREA IS CONTAINED, AND THERE'S A VENEER ON IT THAT MATCHES THE FIRE STATION SITE.

ITS CELL TOWER IS CONTAINED IN THE STRUCTURE.

I'VE PUT TOGETHER A CHART OF THE REGULATIONS FOR THE BUILDING SETBACKS AND THE GOVERNMENT USE DISTRICT, AS WELL AS THE NONRESIDENTIAL WIRELESS COMMUNICATION FACILITIES.

THESE WIRELESS COMMUNICATIONS FACILITIES ARE ALLOWED TO BE 65FT OR UP TO 80FT WITH HEIGHT CREDITS.

THE PROPOSED APPLICATION IS 130-FOOT TOWER WITH A FOUR-FOOT LIGHTNING ROD.

I UNDERSTAND THERE WERE PREVIOUS DISCUSSIONS ON THIS PROPERTY AND THE CELL TOWER, AND ORIGINALLY IT WAS 150FT BEING PROPOSED, SO IT'S BEEN BROUGHT DOWN AT 20FT.

THE FRONT SETBACKS IN THE GOVERNMENT USE IS 50FT, AND IN THE WIRELESS COMMUNICATIONS IT'S NOT ALLOWED WITHIN THE FRONT YARD.

THE FRONT YARD ON THIS PARTICULAR LOT IS 100FT, AND THEY ARE PROPOSING THE STRUCTURE TO BE SET BEHIND THAT 100-FOOT SETBACK REQUIREMENT.

THE REAR YARD IN THE GOVERNMENT USES 50FT.

THE NONRESIDENTIAL WIRELESS COMMUNICATION FACILITIES.

IT'S ALLOWED IN REAR YARDS BEHIND THE REQUIRED BUILDING SETBACK, WHICH IS 50FT.

THEY ARE PROPOSING THE EIGHT-FOOT MASONRY WALL STRUCTURE TO BE RIGHT ON THE PROPERTY LINE AND THE CELL TOWER STRUCTURE THAT IS JUST WEST OF THE EQUIPMENT IS ABOUT 24FT FROM THE REAR PROPERTY LINE.

SETBACKS FROM RESIDENTIAL ZONING DISTRICTS.

IT'S THERE ARE NONE IN THE GU DISTRICT.

AND THEN IN THE REGULATIONS FOR WIRELESS COMMUNICATIONS FACILITIES, IT'S A TWO-FOOT SETBACK FROM RESIDENTIAL ZONING DISTRICTS.

THE ZONING DISTRICTS TRADITIONALLY GO TO THE CENTER LINE OF STREETS, SO IN THIS PARTICULAR CASE, THE SETBACK WOULD BE 260FT.

THE PROPOSAL BEFORE YOU THIS EVENING IS 166FT.

HOWEVER, THEY DO HAVE GRAPHICS IN YOUR AGENDA PACKET THAT ILLUSTRATES THERE'S 285FT TO THE NEAREST RESIDENTIAL STRUCTURE. NOW ALSO POINT OUT THERE'S AN ASTERISK AT THE BOTTOM THAT TOWN COUNCIL HAS THE ABILITY TO CHANGE A SETBACKS AND REGULATIONS IN THE GU DISTRICT.

AND THERE'S ALSO RESERVED SPACE FOR A TOWN OF WESTLAKE EMERGENCY SERVICES.

THERE WAS A COMMUNITY MEETING HERE AND A HALF AGO OR SO WHERE WE GOT SOME FEEDBACK WITH SOME CONCERNS, NEIGHBORS ABOUT ESTHETICS.

AND IN RESPONSE TO THAT AND WORKING WITH THE PROVIDERS, WE DID, AS WAS MENTIONED, LOWER THE PROPOSED HEIGHT BY 20FT.

WHEN THIS WAS PREVIOUSLY CONSIDERED, AND WHEN THE TOWN POLICE CONTEMPLATED THAT IT WOULD BE 150FT HIGH.

THIS PROPOSAL IS FOR 130, AND THE COMPANIES HAVE INDICATED THAT THEY CAN STILL MEET THEIR OBJECTIVES AT THIS LOWER HEIGHT.

THIS WILL ADDRESS A CRITICAL GAP IN SERVICE FOR MULTIPLE PROVIDERS, AS ILLUSTRATED BY THE COVERAGE MAPS THAT I'LL GET TO SHORTLY FROM THE THREE PROVIDERS.

AS A UNIFIED SHARED STRUCTURE, IT AVOIDS THE NEED FOR SEPARATE SITES FOR EACH PROVIDER.

EVERYTHING'S COMBINED INTO THIS ONE DESIGN.

THE CORE AREA OF NEED FOR IN-BUILDING IMPROVEMENT IS ROUGHLY A MILE RADIUS AROUND THE FIRE STATION.

THERE ARE NO EXISTING TOWERS OR TALL STRUCTURES IN THIS AREA.

THE CLOSEST EXISTING TOWERS TO THIS LOCATION IS AN AMERICAN TOWER, A SELF-SUPPORTING LATTICE SITE WHICH IS 330FT TALL AT 3700 NORTH WHITECHAPEL BOULEVARD IN SOUTHLAKE.

VERIZON AND T-MOBILE ARE ALREADY ON THIS TOWER.

AT&T IS NEARBY AT A TROPHY CLUB WATER TANK, AND THE OTHER LOCATION TO THE SOUTHWEST IS A PINNACLE TOWERS LOCATION, WHICH IS A 275-FOOT GUYED TOWER.

AND ALL THREE PROVIDERS ARE ALREADY ON THIS.

THERE'S KIND OF AN AERIAL VIEW THAT THAT SHOWS THESE LOCATIONS.

THE PROPOSED SITE IS THE RED PUSHPIN, KIND OF IN THE MIDDLE OF THE PICTURE.

TO THE RIGHT-HAND SIDE ARE THE AMERICAN TOWER SITE I MENTIONED WITH VERIZON AND T-MOBILE ON IT.

AND THEN THE OTHER PUSHPIN NEAR THAT IS THE TROPHY CLUB WATER TANK WHERE AT&T IS LOCATED.

AND TO THE SOUTHWEST, ON THE LEFT-HAND SIDE OF THE PHOTO IS THE PINNACLE TOWERS LOCATION, WHERE ALL THREE PROVIDERS ARE ALL CURRENTLY LOCATED.

THE INTENT OF THIS ONE IS TO IMPROVE THE COVERAGE AND HELP OFFLOAD CAPACITY FOR THIS AREA IN THE MIDDLE.

THIS IS THE EXISTING VERIZON COVERAGE RIGHT NOW.

THE KIND OF RED AREA ON THE RIGHT IS THEIR EXISTING LOCATION.

THE ATC TOWER AND THE LAB ON THE LOWER LEFT IS THE PINNACLE TOWER.

LOCATION. IN THE MIDDLE IS A MAIN AREA OF THE WEAKEST SIGNAL.

THE GOAL IS TO FILL IN THIS AREA FOR IN-BUILDING COVERAGE.

ON THIS NEXT SLIDE IS VERIZON AT 120FT AT THE PROPOSED SITE.

YOU SEE, IT CREATES ITS OWN AREA OF STRONG SIGNAL TO KIND OF FILL IN THAT GAP BETWEEN SITES.

HERE AGAIN, IS THE AT&T COVERAGE.

SIMILAR SITUATION TO THE VERIZON.

WE'VE GOT AREA OF WEAK SIGNAL AND LACK OF IN-BUILDING COVERAGE IN BETWEEN THE EXISTING SITES.

AND HERE'S WITH AT&T AT 110 FILLING IN THAT GAP IN THE SITES.

THIS IS A T-MOBILE COVERAGE MAP.

THIS IS PULLED BACK A LITTLE BIT FURTHER THAN THE PREVIOUS CARRIERS, SO IT SHOWS MORE SITES, BUT THERE'S BASICALLY A DONUT HOLE OF GRAY IN THE MIDDLE WHERE THERE'S A LACK OF IN-BUILDING SERVICE.

IN THIS CASE, THE NEIGHBORHOOD THAT WE'RE LOOKING AT IS THE TOP HALF OF THAT DONUT HOLE.

AND WITH T-MOBILE AT 100FT AS PROPOSED, IT FILLS UP HALF OF THAT WHOLE.

AGAIN, THERE WERE NO EXISTING TOWERS IN THIS AREA BETWEEN THE TOWERS THAT THE CARRIERS ARE ALREADY LOCATED ON.

THERE IS A LARGE LANDOWNER IN THE VICINITY OF THIS INTERSECTION, WHICH IS A FIDELITY INVESTMENTS CAMPUS.

HOWEVER, THEY WERE NOT WILLING TO ENTERTAIN TOWER ON THEIR PROPERTY SO THAT PARCEL WAS NOT AVAILABLE.

SO, THE FIRE STATION WAS REALLY THE PARCEL AVAILABLE? YEAH. LEASE WAS APPROVED BY TOWN COUNCIL BACK IN JANUARY 24TH, 2022.

AGAIN, WHAT WAS CONTEMPLATED AT THAT TIME WAS 150 FOOT.

TOWER ITSELF DOES RESERVE SPACE IN THE FACILITY FOR EMERGENCY SERVICES EQUIPMENT.

NOW THE NEXT STEP IS FOR US TO GO THROUGH ZONING AND PROCESS.

YO! IT'S BACK.

IT'S A SITUATED ON THE WESTERN PORTION OF THE FIRE STATION.

PARCEL STRUCTURE AND WALL AROUND THE EQUIPMENT COMPOUND WILL ARCHITECTURALLY MATCH THE FIRE STATION.

THE ACCESS FROM DELVE ROAD WILL BE USING THE EXISTING CONCRETE DRIVE.

SEE IN BLUE IS THE 25 BY 25-FOOT FOOTPRINT FOR THE STRUCTURE ITSELF, AND THEN THE 50 BY 50-FOOT COMPOUND FOR THE ASSOCIATED GROUND EQUIPMENT.

AND THERE'S A LITTLE DRIVE, A NEW SET OF DRIVEWAYS THAT WILL RUN OFF THE EXISTING DRIVE NORTH INTO THAT COMPOUND AREA.

SO, WHILE GUIDELINE NUMBER IS PROVIDED, WE FEEL THAT THIS PARTICULAR LOCATION, GIVEN THE CIRCUMSTANCES, IS APPROPRIATE GIVEN THE RESIDENTIAL TO THE SOUTH ACROSS DOVE ROAD, WE WANT TO BE AS FAR NORTH AS WE CAN ON THE PROPERTY ADJACENT TO THE NORTH.

HOW WILL THIS AFFECT HOME VALUES? THE NATIONAL ASSOCIATION OF REALTORS STATES, ON AVERAGE, A NEGATIVE PRICE IMPACT OF 9.78% IF IT'S VISIBLE 150FT IS VISIBLE FOR MANY, MANY MILES.

JUST ON OUR CUL DE SAC, WE ESTIMATE THE PROPERTY VALUE LOSS WILL BE NEARLY $2 MILLION, AND THERE ARE FOUR CUL DE SACS THAT BACK UP TO THIS PROPERTY RIGHT OFF OF DOVE ROAD. ANOTHER ARTICLE I FOUND STATES THAT 94% OF HOME BUYERS FEEL THAT A NEARBY CELL TOWER WOULD NEGATIVELY IMPACT INTEREST IN A PROPERTY, AND THEY DOCUMENT PRICE DROPS OF NEARLY 20% IN PUBLISHED ARTICLES.

A THIRD CONCERN I HAVE THAT I DID A LOT OF RESEARCH ON IS LIGHTNING.

LIGHTNING ACTIVITY HAS BEEN INCREASING IN RECENT YEARS WITH THE LATEST MODELS PREDICTING AN INCREASE OF 50% BY THE END OF THE CENTURY.

ONE RECENT CALIFORNIA STORM WAS NOTED TO SPAWN 15,000 STRIKES IN A 24-HOUR PERIOD.

LIGHTNING STRIKES ARE MORE LIKELY IN THE VICINITY OF ELEVATED STRUCTURES SUCH AS CELL TOWERS.

THE PROTECTION OF CELLULAR EQUIPMENT SHOULD NOT BE OVERESTIMATED, SINCE LIGHTNING DOES NOT ALWAYS HIT THE TALLEST STRUCTURE.

WITH LIGHTNING STRIKES, THE LARGE AMOUNT OF CURRENT IS INJECTED AND DISSIPATED NEAR THE TOWER, CAN INCREASE VOLTAGE GRADIENTS IN THE EARTH AND FIND ITS WAY INTO NEARBY DWELLINGS, AS IN THE RECENT STORM THAT BURNED OUT A ROUTER AND OUR RECEIVER FOR ALL OF OUR TELEVISION EQUIPMENT.

EVEN WITH ALL OF OUR SURGE PROTECTORS, UNFORTUNATELY, NO PRACTICAL SOLUTIONS EXIST, BUT AWARENESS SHOULD INFORM LOCATING THESE TOWERS IN HIGHLY POPULATED AREAS. IN A JULY 2021 STUDY, HEALTH IMPACT OF 5G BY THE EUROPEAN PARLIAMENTARY RESEARCH SERVICE, THEY FOUND THAT WIRELESS EMISSIONS IN 5G AND 4G ARE PROBABLY CARCINOGENIC TO HUMANS WITH GLIOMAS, TUMORS THAT START IN THE BRAIN OR SPINAL CORD, AND ACOUSTIC NEUROMAS.

THEY MAY AFFECT MALE FERTILITY, FEMALE FERTILITY, WITH ADVERSE EFFECTS ON THE DEVELOPMENT OF EMBRYOS, FETUSES, AND NEWBORNS.

SO, FOR EXAMPLE, THEY'RE CONCERNED ABOUT ESTHETICS, EVEN IF THEY'RE TRIED TO BE AN IMPROVEMENT.

IT IS LARGE.

I WOULD EVEN CALL IT OBNOXIOUS FROM GAILLARDIA COURT.

THEY ARE WORRIED ABOUT HEALTH RISKS.

THERE IS ALSO LOTS OF DATA THAT SHOWS THAT MARKETABILITY FOR THESE HOMES THAT SIT BY CELL PHONE TOWERS ALSO SIT ON THE MARKET FOR A VERY LONG TIME.

SO, VACCARO IS THE MOST PRESTIGIOUS COMMUNITY THAT WE HAVE HERE IN WESTLAKE.

AND I DON'T KNOW IF YOU ALL ARE AWARE, BUT YEAR TO DATE, THE ONLY SINGLE FAMILY CLOSED PROPERTIES IN 2024 ARE IN VACCARO.

RIGHT. SO FIRST WHEN WE LOOK AT TECHNOLOGY WE'RE MOVING FROM 4G TO THE 5G.

SO EVEN WHILE WE'RE SITTING IN THE OFFICE WE'RE STILL ON 4G EVEN THOUGH WE HAVE THESE TOWERS COMING IN.

BECAUSE WHEN WE MOVE TO 5G, THE FREQUENCY IS HIGHER THAN 4G.

SO WHEN WE LOOK AT THE MAPS, WE'RE LOOKING AT 4G LOW BAND, WHICH IS WHAT WE KIND OF RELY ON WHEN WE LOOK AT IN-BUILDING, YOU KNOW, LIKE SOMETHING WAS INSIDE YOU KNOW, VERSUS SOMEONE WHO'S OUTSIDE.

SO WHEN WE LOOK AT TECHNOLOGY, WE'RE MOVING TOWARDS 5G.

SO YOU'RE GOING TO NEED, YOU KNOW, ANOTHER TOWER JUST TO EVEN HELP THE OTHER TOWERS JUST TO GET A 5G SIGNAL, NOT EVEN HELP THE OTHER TOWERS, BUT JUST TO GET A 5G SIGNAL.

WE NEED THE TOWER.

SO, I MEAN, THAT'S REALLY THE TECHNOLOGY CHANGE THAT WE'RE MOVING INTO NOW.

YOU KNOW, IF YOU'RE GOING TO LOOK FIVE YEARS FROM NOW, I DON'T KNOW WHAT'S GOING TO HAPPEN.

YOU KNOW, 60, WHATEVER IT IS.

BUT THE FREQUENCY KIND OF GOES UP.

THAT MEANS WE NEED MORE OF THIS.

SMALL CELLS IS GREAT, BUT IT WORKS WHERE YOU HAVE, YOU KNOW, RIGHT OF WAY PROPERTIES.

WE SUFFER FROM A CAPACITY PERSPECTIVE.

WE'RE GETTING SO MUCH TRAFFIC ON IT, IT GETS BLOCKED, YOU KNOW, ESPECIALLY ON THE 114 BECAUSE THE TRAFFIC IS KIND OF BALANCED.

IT'S GOING TO HELP YOU WITH, YOU KNOW, SOME IT'S GOING TO IT ONLY TAKES TRAFFIC FROM A CERTAIN DISTANCE FROM THE SMALL CELL.

IT'S NOT GOING TO TAKE AN OVERALL PERSPECTIVE AND, YOU KNOW, HELP IN BUILDING AND ALL THAT.

SO THAT'S NOT REALLY THE ALTERNATIVE WE WANT TO TAKE.

SO WE CANNOT TRANSMIT BEYOND A CERTAIN LIMIT IN ANY AREA.

AND SOME OF THESE WI-FI'S THAT WE HAVE, THEY TRANSMIT AT A HIGHER FREQUENCY LEVEL THAN EVEN WHAT WE CAN OWN.

SO, YOU KNOW, I JUST WANTED TO POINT THAT OUT.

IN TERMS OF THE LEASE WITH THE CITY IN MOST CASES WHERE YOU'RE PROVIDING INFRASTRUCTURE TO MEET THE COMMUNITY NEEDS, THE CITY'S SPENDING MONEY. I THINK PART OF THE APPROACH HERE WAS LOOKING AT, HEY, WE'VE GOT A NEED IN THE COMMUNITY.

WE NEED TO HAVE INFRASTRUCTURE TO ADDRESS.

HERE'S THIS PRIVATE COMPANY THAT'S KIND OF COME IN AND THEY'RE GOING TO SPEND THE MONEY TO BUILD IT.

WE DON'T HAVE TO SPEND THE MONEY FOR THE INFRASTRUCTURE.

I THINK THAT'S PART OF THE EQUATION.

THE LEASE, AS IT'S STRUCTURED WITH THREE CARRIERS ON THE TOWER $1,300 A MONTH, A TOTAL OF $15,600 A YEAR.

BUT I THINK THAT'S NOT THE ONLY EQUATION.

I THINK THE OTHER PARTS OF THAT EQUATION WERE WE'RE MEETING THE NEED OF THE COMMUNITY WITHOUT EXTRA OUT-OF-POCKET COSTS TO US AS A COMMUNITY, AND THERE'S SPACE RESERVED FOR EMERGENCY SERVICES, ANTENNAS, WHICH IS ALSO WORTH SOMETHING.

SO IN TERMS OF I THINK, I THINK IN TERMS OF A WHOLE PACKAGE, THIS IS INFRASTRUCTURE NEEDED TO HELP THE COMMUNITY THAT YOU'RE GETTING WITHOUT COST TO THE CITY IN TERMS OF PROPERTY VALUES.

I'VE HEARD A LOT OF STUDIES MENTIONED.

I HAVEN'T SEEN ANY STUDIES PRESENTED.

TO ACTUALLY GO ABOUT STUDYING THIS, YOU'D NEED TO HAVE A CERTIFIED APPRAISER DO COMPARISONS WITH SIMILAR TYPES OF STRUCTURES.

THIS IS NOT A STANDARD CELL TOWER.

THEY'D HAVE TO LOOK AT OTHER CLOCK TOWER, BELL TOWER, STEEPLE TYPE ISSUES.

AND FROM WHAT I'VE SEEN, THERE ISN'T THE SIGNIFICANT TYPES OF PROPERTY VALUES THAT THEY'RE TALKING ABOUT FROM A HEALTH STANDPOINT.

THESE SITES ARE FULLY COMPLIANT WITH ALL THE FCC REQUIREMENTS.

THESE ARE LOW LEVEL, NON-INTENSE TYPE FREQUENCIES, NON-IONIZING RADIATION.

THE FCC HAS LOOKED AT THAT.

PART OF THE TELECOMMUNICATIONS ACT OF 1996 INCLUDES A SECTION IN 47 U.S.C.

SECTION 332, SUBSECTION C, SUBSECTION SEVEN B, OR THAT SAYS NO STATE OR LOCAL GOVERNMENT OR INSTRUMENTALITY THEREOF MAY REGULATE THE PLACEMENT, CONSTRUCTION OR MODIFICATION OF PERSONAL WIRELESS SERVICE FACILITIES ON THE BASIS OF THE ENVIRONMENTAL EFFECTS OF RADIOFREQUENCY EMISSIONS, TO THE EXTENT THAT SUCH FACILITIES COMPLY WITH THE COMMISSION'S REGULATIONS CONCERNING SUCH EMISSIONS.

THE REASON THEY'RE DOING THAT IS NOT TO COVER OVER SOME HEALTH CONCERN THAT'S OUT THERE, BUT BECAUSE IT'S FEDERAL POLICY TO ENCOURAGE THE DEVELOPMENT OF THIS INFRASTRUCTURE.

AND THEY'VE LOOKED AT IT AND FOUND THAT THERE'S NOT THE BASIS FOR HAVING A HEALTH CONCERN.

IF ANTENNAS ARE AT LEAST TEN METERS ABOVE THE GROUND ABOUT 33FT, THEY AUTOMATICALLY DEEM THAT WHAT THEY CALL CATEGORICALLY EXCLUDED FROM REVIEW FOR EMISSIONS, BECAUSE IT'S NOT A SITUATION WHERE, AS CHIRAG MENTIONED, YOU'VE GOT SOMEONE ON A ROOFTOP STANDING IN FRONT OF AN ANTENNA.

THE EXPOSURE IS JUST SO MINIMAL THERE'S NOT A HEALTH CONCERN.

AND ALSO, WHEN YOU'RE SPEAKING OF HEALTH, YOU'VE GOT TO BALANCE THE OTHER SIDE OF THE EQUATION.

IF YOU'RE NOT GETTING THE KIND OF SERVICE YOU NEED.

BUT SMALL CELL TOWERS CAN BE BUILT IN A MANNER WHERE THEY CAN HAVE MORE THAN ONE CARRIER ON THEM.

AND WE DO.

THERE IS A PLAN IN PLACE, OR A MODEL THAT'S BEING CREATED BY THE AT&T BY THEIR ENGINEERING GROUP TO COVER THE TOWN OF WESTLAKE WITH SMALL
