THE SEGUE TO THAT IS GOING TO BE A SURVEY THAT WE JUST RELEASED JUST A FEW DAYS AGO.
WE SENT THAT OUT TO ALL OF THOSE FOLKS THAT I JUST MENTIONED.
SO STAFF MEMBERS, PARENTS, RESIDENTS, STAKEHOLDERS, BUSINESS OWNERS, DEVELOPERS AS WELL.

OUR FALL CLEANUP EVENT THAT HAPPENED OVER THE WEEKEND ON SATURDAY WAS A BIG HIT, FROM WHAT WE'RE TOLD, DIANA AND PUBLIC WORKS AND OBVIOUSLY SHE WORKS HEAVILY WITH THE FINANCE FOLKS AS WELL PUT ON A GREAT DEAL FOR RESIDENTS TO COME BY AND DROP OFF ALL THEIR UNWANTED HOUSEHOLD ITEMS. WE SAID, I GUESS THERE WAS, WHAT, 30 PEOPLE WHO SHOWED UP, WHICH WAS GREAT.
THAT WAS MORE THAN LAST YEAR, WHICH WAS HUGE.
I THINK THE BIG THE BIG HIT WAS THE CRUD CRUISER.
OBVIOUSLY WE DON'T WANT THEM IN OUR LANDFILLS OR OUR WATER SYSTEMS. SO, SO GREAT JOB TO DIANA AND ALL THAT CREW FOR PUTTING THAT ON.
SO WE WILL CONTINUE THAT NEXT YEAR.
AND THOSE ARE YOUR ITEMS OF COMMUNITY INTEREST.

WE'RE TEN MINUTES IN THE MEETING.AGENDA ITEM G1, ORDINANCE 1009.
DISCUSS, CONSIDER AN ACT REGARDING ADOPTION OF ORDINANCE 1009, DELEGATING TEMPORARY PLAT APPROVAL AUTHORITY AND EXTENSION APPROVAL AUTHORITY PURSUANT TO THE PROVISIONS OF CHAPTER 212 OF THE TEXAS LOCAL GOVERNMENT CODE, AS AMENDED, AND CHAPTER 82 OF THE TOWN OF WESTLAKE CODE OF ORDINANCES, AS AMENDED TO THE TOWN PLANNER, JASON ALEXANDER.
THIS IS A REQUEST FROM THE DEPARTMENT OF PLANNING AND DEVELOPMENT TO AMEND TEMPORARILY THE AUTHORITY TO REVIEW AND APPROVE PLATS. THIS IS DUE TO HOUSE BILL 3699, WHICH WAS ENACTED ON SEPTEMBER 1ST OF 2023.
AND AS PART OF THAT HOUSE BILL, IT AMENDED A LOT OF THE STATUTES DEALING WITH PLANNING FOR MUNICIPALITIES AND COUNTIES ACROSS THE STATE. AMONG OTHER THINGS, IT DID INCLUDE THE PROVISION THAT OFFICERS OR EMPLOYEES MAY IMPROVE PLATS, APPROVE PLATS WITH CONDITIONS, OR DENY PLATS, AND THAT IS PART OF THE WHOLE DESIRE OF THE STATE TO MAINTAIN ITS POSITION WITHIN A NATION AS BEING ECONOMIC DEVELOPMENT, FRIENDLY AND PRO-BUSINESS.
AND IT IS ALSO TO HELP MUNICIPALITIES AND COUNTIES EXPEDITE THE PLAT REVIEW AND APPROVAL PROCESS.
AGAIN, THIS ORDINANCE IS ONLY MEANT TO BE TEMPORARY, AND THAT IS TO ALLOW TIME FOR THE DEPARTMENT OF PLANNING AND DEVELOPMENT TO GO THROUGH TO REDLINE PROPOSED AND PRESENT AMENDMENTS TO THE TOWN COUNCIL, AS WELL AS THE PLANNING AND ZONING COMMISSION.
AND THE CONSIDERATIONS THAT ENSUE WITH REGARDS TO THIS ORDINANCE ARE AS FOLLOWS ONE.
AGAIN, HAVING THE APPROPRIATE AMOUNT OF TIME TO REVIEW THE EXISTING PLANNING REGULATIONS AND ENSURING THAT THOSE ARE CONSISTENT WITH THE RECENT AMENDMENTS TO STATE LAW. IT'S AN EXPEDITED DEVELOPMENT REVIEW AND APPROVAL PROCESS.
SO IN THEORY, THE ONLY TIME A PLAT SHOULD COME BEFORE THE PLANNING AND ZONING COMMISSION OR THE TOWN COUNCIL IS IF A VARIANCE IS REQUESTED OR IF IT IS DENIED. THE AMENDMENTS TO STATE LAW ARE VERY CLEAR THAT IF A PLAT MEETS ALL OF THE REQUIREMENTS THAT A TOWN HAS, THERE CAN BE NO REASON TO DENY THAT PLAT. SO AGAIN, LEADING TO THAT EXPEDITED DEVELOPMENT, REVIEW AND APPROVAL PROCESS, IT DOES LEAD TO A MORE PREDICTABLE ENVIRONMENT FOR INVESTMENT.
AND THEN FINALLY THAT THOSE RULES AND REGULATIONS, THEY ARE IN COMPLIANCE WITH STATE LAW.
DEPARTMENT OF PLANNING AND DEVELOPMENT DOES RECOMMEND APPROVAL OF THE ORDINANCE AS PRESENTED, AND I WILL PAUSE THERE WITH A LIST OF TOWN COUNCIL ACTIONS AND OPTIONS IN FRONT OF YOU, AS WELL AS TO ANSWER ANY QUESTIONS YOU MAY HAVE.
