[00:00:02] WE'RE GOOD TO GO. [A. CALL REGULAR MEETING TO ORDER AND ANNOUNCE A QUORUM PRESENT] GOOD EVENING, AND WELCOME TO THE WESTLAKE TOWN COUNCIL BOARD OF TRUSTEES MEETING FOR NOVEMBER 11TH, 2024. I CALL THE MEETING TO ORDER. THE TIME IS 4:00 AND A QUORUM IS PRESENT. AND I THINK COUNCILWOMAN WHITE IS ON ZOOM. I'D LIKE TO START THIS. ANNE, ARE YOU THERE? OH, I SEE YOU. EXCELLENT. THANK YOU. THIS EVENING, THE INVOCATION WILL BE LED BY PASTOR CLAYTON REED FROM SOUTHLAKE BAPTIST CHURCH. THANK YOU FOR BEING HERE. THANK YOU, MAYOR. LET'S PRAY TOGETHER. FATHER, WE GIVE THANKS FOR THIS EVENING. AND TONIGHT ESPECIALLY. WE REMEMBER AND GIVE THANKS FOR VETERANS. AND WE GIVE THANKS FOR THEIR SERVICE, THEIR COMMITMENT TO OUR COUNTRY, THEIR LOVE OF SERVICE. AND WE JUST THANK YOU, LORD, FOR PEOPLE LIKE THAT WHO GIVE UP CHUNKS OF LIFE TO SERVE US AND TO KEEP US SAFE AND PROTECT US AROUND THE WORLD WHERE WE THINK OF SOLDIERS RIGHT NOW ALL OVER THE GLOBE THAT ARE MAKING AMERICA SAFE AND MAKING OUR COUNTRY STRONG. AND WE PRAY BLESSING OVER EVERY ONE OF THEM. THAT'S IN A HOSTILE SITUATION RIGHT NOW. WE PRAY THAT YOU WOULD PROTECT THEM AND GIVE THEM WISDOM, BUT WE ALSO GIVE THANKS FOR THE TOWN OF WESTLAKE AND WE PRAY BLESSING OVER THIS CITY WHERE THERE'S SUCH A BLESSING TO BE IN THIS AREA. AND I THANK YOU FOR ALL OF THE GOODNESS THAT YOU GIVE US, THE PROTECTIONS, THE SAFETY, THE PEACE. AND WE PRAY TONIGHT, AS THIS COUNCIL MEETS, THAT YOU WOULD GIVE THEM WISDOM AND BLESSING AND HELP. AND I PRAY AS THEY COME ACROSS DECISIONS AND LISTEN TO THINGS THAT YOU WOULD GIVE THEM SPECIAL GRACE AND THAT YOU WOULD BRING PEACE TO THIS ROOM. LORD, WE ALSO PRAY FOR WESTLAKE ACADEMY AND DOCTOR RITCHIE. WE PRAY BLESSING UPON HER AND HER TEAM, AND WE PRAY THAT AS SHE MAKES DECISIONS AND MOVES FORWARD, THAT YOU WOULD HELP THEM AND BLESS THEM AS A SCHOOL. LORD, WE THANK YOU FOR YEARS OF HELPFUL WORK THERE AND WE PRAY FOR MORE AND MORE BLESSING AND MORE PEACE AND MORE SUCCESS. THANK YOU FOR YOUR GOODNESS TO US AND LORD, WE GIVE THANKS TONIGHT FOR JESUS AND IT'S IN HIS NAME WE PRAY. AMEN. AMEN. THANK YOU VERY MUCH. THANK YOU FOR BEING HERE. PLEASE RISE AND JOIN ME TO RECITE THE PLEDGE OF ALLEGIANCE AND THE PLEDGE TO THE TEXAS FLAG. ALL RIGHT. THANK YOU. EVERYBODY. TONIGHT, WE HAVE ASPEN DURIS AND ASPEN'S TEACHER SAYS SHE'S ALWAYS CURIOUS AND ENJOYS SHARING HER KNOWLEDGE WITH OTHERS AND IS PRINCIPLED IN HER ACTIONS. ASHER DURIS, WHOSE EIGHTH GRADE HAS SHOWN IMPRESSIVE EFFORTS AND GROWTH THIS YEAR AND ENJOYS PLAYING FOOTBALL, BASKETBALL AND TRACK. AND THEN WE HAVE MASE RAYMOND IN FIFTH GRADE, AND MASE LED A TEAM OF HIS WESTLAKE ACADEMY CLASSMATES TO PLAY IN A MIDDLE SCHOOL MATCHUP OF 42 EIGHTH GRADE TEAMS ACROSS DFW. THEY DIDN'T TAKE HOME THE TROPHY, BUT THEY GOT WHAT THEY GAINED IN SCHOOL SPIRIT IN THE WAY THEY REPRESENTED WESTLAKE ACADEMY AMONGST THEIR PEERS ACROSS THE DFW WAS WORTH FAR MORE THAN THE TROPHY. SO THANK YOU ALL FOR BEING HERE TONIGHT. Y'ALL COME OVER ON THIS SIDE. WE'RE GOING TO START WITH THE PLEDGE OF ALLEGIANCE. WE'RE GOING TO GET UP. NOW [C. CITIZEN/PARENT COMMENTS] AGENDA ITEM C CITIZEN AND PARENT COMMENTS. WE HAVE ERIC ROWELL. THANK YOU. SORRY, I CAN'T READ THAT. IF YOU PLEASE COME UP, STATE YOUR NAME AND ADDRESS. WELCOME. ERIC ROWELL, 11325 GILL RIDGE TERRACE, FORT WORTH. 76052. [00:05:01] MAYOR. COUNCIL. GOOD AFTERNOON. I'M HERE TO SPEAK TO YOU REGARDING THE APPOINTMENT ELECTION THAT YOU ALLOCATE YOUR VOTES ON TONIGHT. IT'S THE FIRST OPPORTUNITY I'VE HAD TO SPEAK WITH YOU. SO THANK YOU. FOR THE VETERANS ON THE BOARD, THANK YOU FOR YOUR SERVICE TO THE VETERANS OUT IN THE AUDIENCE. THANK YOU FOR YOUR SERVICE. HAPPY VETERANS DAY. I EMAILED YOU ALL ON NOVEMBER 2ND, DISCUSSING MY VISION FOR THE DISTRICT AND CERTAIN ACTIONS THAT HAVE TAKEN DOWN THERE. AND NOW I'M HERE JUST TO INTRODUCE MYSELF, PUT A FACE TO THE NAME. I WAS NOMINATED BY EAGLE MOUNTAIN, SAGINAW ISD, LAKE WORTH ISD, CITY OF WATAUGA, HALTOM CITY, AND TARRANT COUNTY COMMUNITY COLLEGE. IN ADDITION TO WHAT I SPOKE ABOUT IN MY EMAIL, I'D LIKE TO SEE THREE THINGS CHANGED AT THE APPRAISAL DISTRICT. THEY ARE THE TRANSPARENCY, CULTURE, AND COMMUNICATION DOWN THERE. FOR TRANSPARENCY, I WANT OPEN DIALOG, AND I WANT THE REASONS FOR THE DECISIONS THAT THEY MAKE TO BE OUT IN THE OPEN FOR EVERYONE TO SEE AND UNDERSTAND. FOR CULTURE, I WANT TO FOSTER AN ENVIRONMENT OF COLLABORATION. IF YOU'VE BEEN PAYING ATTENTION TO THE BOARD LATELY, THERE'S A LEVEL OF ANIMOSITY AMONGST ITS MEMBERS AND I CAN'T UNDERSTAND HOW IT'S BENEFICIAL FOR ANYONE. IT'S A TEAM EFFORT, AND EVERYONE NEEDS TO WORK TOGETHER TO ENSURE A HIGH LEVEL OF FUNCTION AND SERVICE. TAXPAYERS, TAX ENTITIES IN THE DISTRICT. THE APPRAISAL NEEDS TO WORK TOGETHER TO TREAT THE TAX ENTITIES LIKE A PARTNER, AND THEY NEED TO TREAT THE TAXPAYERS WITH RESPECT. AS A BOARD MEMBER, HELPING ONE GROUP MUST NOT COME AT THE EXPENSE OF THE OTHER GROUP. POLICIES CAN BE DEVELOPED TO HELP ALL SO LONG AS THERE IS CLEAR COMMUNICATION BETWEEN THE PARTIES. THE COMMUNICATION I WANT STAFF TO GET OUT OF THE OFFICE AND SHOW UP AT COMMUNITY TOWN HALLS TO BE ACCESSIBLE TO RESIDENTS AND BUSINESSES AND ANSWER QUESTIONS. I'D ALSO LIKE THEM TO COORDINATE WITH THE TAX ENTITIES, TO SHOW UP AT A PUBLIC MEETING AND TALK ABOUT THE ACTIVITIES OF THE APPRAISAL DISTRICT AND ANY ACTIONS THEY MAY BE CONSIDERING. I BELIEVE THIS WILL FOSTER BETTER TWO WAY COMMUNICATION AND KEEP EVERYONE INVOLVED, AND ALSO ADDS A LAYER OF ACCOUNTABILITY TO THE DISTRICT BY THE ENTITIES. THERE IS ONE COMMENT I WOULD LIKE TO MAKE ABOUT THIS PLAN. IF YOU WATCH THE BOARD MEETING ON FRIDAY, CHIEF APPRAISER BOBBITT DID MAKE A COMMENT THAT HE HAS ROUGHLY TEN COMMUNITY EVENTS SET UP. SO THIS HE IS GOING OUT TO SPEAK TO THE PEOPLE AND LET THEM KNOW WHAT THEIR ROLE AND FUNCTION IS. FINALLY, I UNDERSTAND THERE'S 5000 VOTES AND THIS BOARD HAS FOUR VOTES AND THERE ARE 14 NOMINEES. BUT EVERY VOTE MATTERS. AND I KNOW MY NAME RECOGNITION ISN'T ON PAR WITH OTHER INDIVIDUALS, BUT I DO BELIEVE IT'S IMPORTANT TO GET INDIVIDUALS ON THE BOARD WHOSE FIRST PRIORITY WILL BE THE APPRAISAL DISTRICT AND NOT HAVE COMPETING INTERESTS BY BEING ON A SCHOOL BOARD OR CITY COUNCIL. WE NEED TO PROTECT THE RIGHTS OF TAXPAYERS WHILE BALANCING THE INTERESTS OF ENTITIES. I'VE PUT OUT A PLAN AND I'VE LISTED IT IN MY EMAIL AS WELL AS MY BIOGRAPHY FOR YOUR REFERENCE. I INTEND TO WORK WITH ANYONE THAT WANTS TO SOLVE THE APPRAISAL DISTRICT PROBLEMS, BUT I AM AN OUTSIDER TO THIS PROCESS. I KNOW YOU HAVE A LOT TO CONSIDER FOR HOW YOU CAST YOUR VOTES, BUT IF YOU FIND THAT YOUR GOALS, THE GOALS THAT I HAVE PRESENTED, ALIGN WITH YOUR GOALS AND THE GOALS OF YOUR CITIZENS, I'D BE HONORED TO RECEIVE YOUR VOTES. THANK YOU. THANK YOU VERY MUCH. THANK YOU FOR BEING HERE. NEXT SLIDE. I MIGHT BE PRONOUNCING THIS WRONG. I APPRECIATE SIAD SAID. YOU PRONOUNCE IT CORRECTLY. MY NAME IS SAIEDAH SAID, AND MY ADDRESS IS 6705 SAPPHIRE CIRCLE, NORTH COLLEYVILLE, TEXAS 76034. BUT RIGHT NOW I CAME FROM MANSFIELD CITY COUNCIL MEETING. THEY HAVE A 2:30 MEETING. SO I AM ONE OF THE TAD BOARD CANDIDATE ON THE BALLOT. AND IF YOU DECIDE AND IT'S COUNCIL DISCRETION WHO TO VOTE, YOU DECIDE TO VOTE FOR ME. IT'S VERY EASY, GO DOWN THE BALLOT. THE LAST NAME IS MINE AND GIVE ALL FOUR VOTES TO ME. I'M NOT SAYING HE SPLIT THE VOTES. IT'S A REALLY A FIGHT. IT'S A VERY FIRST TIME APPRAISAL. THERE'S SO MANY PEOPLE ARE INVOLVED AND HAVE 14 PEOPLE ON THE BALLOT. THIS IS THE VERY FIRST TIME IN 44 YEARS. AND IF YOU COUNT AS HOW MANY ENTITIES NOMINATE THE PERSON. SO I GOT THE MOST OUT OF 18 ENTITIES. I GOT 13 NOMINATIONS, INCLUDING TEN COUNTY COLLEGE, COMMISSIONERS COURT, FORT WORTH ISD. THE LIST IS ON AND ON, INCLUDING MY OWN CITY, COLLEYVILLE, AND I AM PROUD OF THAT. I USED TO BE A VOLUNTEER FOR THE CITY FOR SEVERAL YEARS. I AM A FORMER APPRAISAL REVIEW BOARD MEMBER, AND I EXACTLY KNOW WHERE THE PROBLEMS ARE. I WAS ONE OF THE WHISTLEBLOWER WHEN IN 2020 AND 2021. THEY WERE THROWING EVIDENCE IN THE TRASH. I WAS THE ONE WHO STEPPED UP AND SAID, NO, THIS IS WRONG. THIS IS AGAINST THE PROPERTY TAX CODE. YOU NEED TO KEEP ALL THE EVIDENCES. YOU CAN'T THROW IT IN THE TRASH. BUT LONG STORY SHORT, I HAVE THREE MINUTES TO SAY. THE JOB OF THE APPRAISAL DISTRICT IS NOT ONLY HIRE AND FIRE CHIEF APPRAISER, THEY HAVE TO CERTIFY THE TAX ROLL BY JULY 25TH. [00:10:06] THERE IS NO JOB RESPONSIBILITY. IS APPOINTMENT OF THE APPRAISAL REVIEW BOARD MEMBERS WITH AT LEAST TWO VOTES FROM ELECTED BOARD MEMBERS BEFORE JULY 1ST. APPRAISAL REVIEW BOARD MEMBERS WERE APPOINTED BY AN ADMINISTRATIVE JUDGE. NOW THE SYSTEM HAS CHANGED, AND LAST BUT NOT THE LEAST IS TO FOLLOW TAXES. PROPERTY TAX CODE. SO YOU AS A TAXING ENTITY, ME AND ALL, ALL OUR AS A TAXPAYER AND THE APPRAISAL DISTRICT, WE ALL BOUND TO FOLLOW THE TAXES PROPERTY TAX CODE TO KEEP THE BALANCE. IF ANYONE DEVIATES FROM THEIR ROLE, IT CREATES THE IMBALANCE. APPRAISAL DISTRICT IS BROKEN BECAUSE TAXING ENTITIES APPOINTED THEIR OWN FELLOWS. SORRY TO SAY. OWN FELLOWS. FORMER OR SITTING CITY COUNCIL MEMBERS, SCHOOL BOARD MEMBERS. AND THEY THINK LIKE TAXING ENTITY. WE ARE SITTING AT THE TAD BOARD. WE NEED PEOPLE WHO CAN UNDERSTAND THE. IT'S THE JOB OF APPRAISAL DISTRICT IS TO PROVIDE THE SERVICE TO THE PEOPLE AND TO THE TAXING ENTITY. THEIR JOB IS, JUST THE BRIDGE BETWEEN A TAXING ENTITY AND TAXPAYER. SO PLEASE GIVE ME VOTE AND BRING THE ACCOUNTABILITY TO THE TAD BOARD. IF YOU DO NOT VOTE FOR ME, YOU DO NOT HAVE ANY RIGHT TO RECALL ME IF I DO NOT FOLLOW THE LAW. SO. OH THAT'S TRUE. THAT IS ABSOLUTELY RIGHT. SO DO YOU WANT TO MAKE ME ACCOUNTABLE, GIVE ME VOTES, HOPE TO GET THE VOTES. AND I'M HEADING TO ANOTHER PLACE. BECAUSE TODAY IS A VERY CRUCIAL DAY. 3 OR 4 ENTITIES ARE VOTING TONIGHT. SO, THANK YOU AND HOPE TO GET VOTES FROM YOU. THANK YOU FOR BEING HERE VERY MUCH. IS THERE ANYBODY ELSE WHO WISHES TO SPEAK? OKAY. WE'RE GOING TO GO IN. I SHOULD HAVE STARTED WITH THIS. [D.1. Veterans Day Proclamation (Mayor Kim Greaves)] HAPPY VETERANS DAY. WE HAVE A PROCLAMATION FOR VETERANS DAY. ON BEHALF OF THE METRO PORT VETERANS ASSOCIATION, CARL MUNGER AND MILAN GEORGIA ARE HERE. VETERANS DAY, NOVEMBER 11TH, 2024. WHEREAS SINCE THE FOUNDING OF OUR REPUBLIC, PATRIOTIC MEN AND WOMEN HAVE FOUGHT FOR OUR FREEDOM BY BUILDING AN HONORABLE TRADITION OF FAITHFUL AND DEDICATED SERVICE TO OUR GREAT NATION. AND WHEREAS THE GALLANT AND SELFLESS SERVICE OF OUR SOLDIERS, SAILORS, AIRMEN, MARINES, COAST GUARDSMEN, AND MERCHANT MARINERS THROUGH THE YEARS HAVE GIVEN US MUCH TO BE PROUD OF. AND WHEREAS VETERANS DAY HONORS THESE GREAT AMERICAN PATRIOTS WHO ANSWERED THE CALL OF DUTY, OFTEN SERVING IN HARM'S WAY TO PRESERVE OUR FREEDOMS. AND WHEREAS WE CONTINUE TO BE INSPIRED BY THE PATRIOTISM AND DEDICATION OF THOSE IN UNIFORM WHO CONTINUE TO DEFEND THE PRINCIPLES ON WHICH OUR NATION WAS FOUNDED. AND WHEREAS, IN HONOR OF THESE DEDICATED MEN AND WOMEN, WE PLEDGE OUR CONTINUED WHO PLEDGE OUR CONTINUED DEFENSE TO OUR NATION SO THAT THEIR SACRIFICE WILL STAND BEFORE THE ENTIRE WORLD, IS A TRIBUTE TO THE SPIRIT, THE SPIRIT AND DETERMINATION OF A PEOPLE DEDICATED TO THE PRINCIPLES OF FREEDOM AND DEMOCRACY. NOW, THEREFORE, I, JIM GREAVES, MAYOR OF THE TOWN OF WESTLAKE, TEXAS, DO HEREBY CALL UPON WESTLAKE RESIDENTS TO OBSERVE MONDAY, NOVEMBER 11TH, 2024, AS VETERANS DAY IN TRIBUTE TO THOSE WHO HAVE THUS ADDED STRENGTH TO THE NATION AND IN RENEWED DEDICATION TO THEIR WORK BUILDING PEACE WITH HONOR AMONG ALL NATIONS. THANK YOU, MAYOR AND COUNCIL. THANK YOU. IT'S GOOD TO SEE YOU ALL. I WANT TO THANK EVERYONE WHO HAS PUT THEIR LIVES BETWEEN THE EVIL THAT THREATENS OUR COUNTRY AND THE FREEDOMS THAT WE ENJOY. THAT'S WHAT THIS DAY IS ALL ABOUT. YOU ARE NOW CONNECTED TO THE GENESIS OF VETERANS DAY BECAUSE MY GRANDMOTHER'S BROTHER, CORPORAL ROY JONES, SERVED IN THE 353RD INFANTRY IN THE 89TH DIVISION IN THE MEUSE-ARGONNE CAMPAIGN. AND HE WAS THERE IN FRANCE WHEN ARMISTICE DAY OCCURRED AND THE CESSATION OF HOSTILITIES ON NOVEMBER 11TH AT 11 A.M. IN 1918, STARTED WHAT WE NOW OBSERVE AS VETERANS DAY. [00:15:03] SO THANK YOU, TOWN OF WESTLAKE, FOR CONTINUING TO OBSERVE THIS. IT'S AN HONOR TO BE HERE. I DO WANT TO SAY THE VETERANS ASSOCIATION MEETS FOR BREAKFAST AT MEET YOU ANYWHERE BARBECUE THE SECOND SATURDAY OF EVERY MONTH AT 9 A.M.. ANYONE IS WELCOME TO COME. YOU BUY YOUR OWN BREAKFAST. WE HAVE SOME GREAT VETERANS THAT TELL THEIR STORIES. IN 2010, VETERANS COMPOSED 10% OF THE US POPULATION. IN 2020, IT WAS 6.5%. TODAY IT'S JUST A LITTLE OVER 5%. AS THE OLDER VETERANS PASS ON, THERE ARE FEWER AND FEWER YOUNGER VETERANS. SO IT'S EVEN MORE IMPORTANT TO TAKE THE EFFORT TO RECOGNIZE VETERANS AND HELP THEM RE-ASSIMILATE BACK INTO SOCIETY AFTER THEY COMPLETE THEIR SERVICE. THANK YOU VERY MUCH. THANK YOU SO MUCH FOR BEING HERE. GREAT JOB. AND I WOULD BE REMISS IF I DIDN'T MENTION MARINE WADE CARROLL AND NAVY TODD GAUTHIER. THEY BOTH SERVE. THANK YOU GUYS SO MUCH. AND IT'S GREAT WORKING WITH YOU ALL. [E.1. Items of Community Interest (Communications Director Jon Sasser)] ITEMS. COMMITTEE INTEREST. JON. GOOD EVENING MAYOR. GOOD EVENING COUNCIL. A FEW THINGS HERE I WANTED TO TALK ABOUT STARTING WITH OUR PLANNING AND ZONING. JUST A REMINDER, THE MEETING THAT WE HAD YESTERDAY FOR TOMORROW HAS BEEN CANCELED, AND THE NEXT ONE IS GOING TO BE ON TUESDAY, DECEMBER 3RD AT 5:00. SO THAT'S GOING TO BE THE NEXT PLANNING AND ZONING MEETING. WE HAVE OUR CHAMBER LUNCHEON COMING UP ON WEDNESDAY, OR RATHER THURSDAY FROM 11 TO 1. I SENT OUT THE RSVP OR THE INVITES AND IF YOU GUYS HAPPEN TO CHANGE YOUR MIND, LET ME KNOW. WE CAN GET YOU IN. ON THE 28TH AND 29TH OF NOVEMBER, WE HAVE TOWN HALL AND MUNICIPAL COURT CLOSED DUE TO THE THANKSGIVING HOLIDAY. AND THEN WHAT WE'RE REALLY EXCITED ABOUT IS THE WESTLAKE TOGETHER TREE LIGHTING EVENT THAT'S ON DECEMBER 4TH FROM 6 TO 8. THAT'S THAT'S A HUGE EVENT. THAT'S OUR BIGGEST ONE OF THE YEAR. IT'S GOING TO BE RIGHT OUT HERE RIGHT BEHIND YOU GUYS. WE'VE GOT ALL KINDS OF STUFF PLANNED BIGGER AND BETTER THAN EVER. YOU KNOW THAT'S WHAT THEY ALWAYS SAY RIGHT. BUT THIS IS TRUE. WE'VE GOT CARRIAGE RIDES. WE'VE GOT MORE VENDORS THAN WE'VE EVER HAD. I THINK WE'VE GOT ABOUT 20 TO 25 VENDORS ALREADY SIGNED UP. WE'VE GOT FOOD THAT'S GOING TO BE HERE. WE'VE GOT LIVE BAND PLAYING, HOLIDAY MUSIC. WE'VE GOT COMPLIMENTARY SANTA AND MRS. CLAUS PICTURES, WE'VE GOT A CHRISTMAS MONKEY, WE'VE GOT LIVE REINDEER, WE HAVE A SNOW MAZE. AND THE MOST TEXAS THING EVER. WE HAVE A MECHANICAL REINDEER, SO NO MECHANICAL BULL, BUT A MECHANICAL REINDEER. WE'RE GOING TO HAVE. AND THEN OF COURSE A DRONE SHOW. SO THAT'S GOING TO BE A LOT OF FUN. WE HAVE A MEETING TOMORROW TO KIND OF PLAN THAT OUT. SO WE'RE SUPER EXCITED. TELL EVERYBODY YOU KNOW IT'S AGAIN IT'S DECEMBER 4TH FROM 6 TO 8. RIGHT OUTSIDE HERE. OUR NEXT TOWN COUNCIL MEETING IS GOING TO BE ON DECEMBER 9TH AT 4 P.M.. AND THEN FINALLY SOME ADDITIONAL NOTES THAT I WANTED TO TALK ABOUT. LET'S TALK ABOUT WINTER QUARTER AVERAGING. THIS IS A BIG DEAL. IF YOU LOVE TO SAVE MONEY, THEN LISTEN UP TO THIS, BECAUSE HOW THIS WORKS IS IN AN EFFORT TO SAVE MONEY ON YOUR SEWAGE BILLS THROUGHOUT THE YEAR, WE AVERAGE THE NEXT THREE MONTHS, DECEMBER, JANUARY AND FEBRUARY. AND BASED WHATEVER YOUR USAGE IS THERE, IT'S SET FOR THE ENTIRE YEAR. THE GOOD NEWS IS, IS TWOFOLD. NUMBER ONE, THAT'S USUALLY THE SMALLEST USAGE PER YEAR OR THOSE THREE MONTHS. AND WE'RE GIVING YOU A HEADS UP SO YOU COULD SAVE, YOU KNOW, EVEN MORE. ON TOP OF THAT, WE HAVE TONS OF WATER CONSERVATION TECHNIQUES, TIPS AND HINTS HENCE ON OUR WEBSITE. WE SEND OUT AN EMAIL A COUPLE OF DAYS AGO AS WELL. SO I INVITE YOU ALL TO LOOK AT OUR WEBSITE FOR THOSE CONSERVATION TIPS. BUT THAT'S A GREAT WAY TO SAVE MONEY ON YOUR SEWER BILL THROUGHOUT THE YEAR. WE ALSO HAVE SOMETHING COMING UP HERE, AND THIS IS ACTUALLY ANY TIME, BUT SPECIFICALLY GERMANE TO THANKSGIVING. IF YOU'RE GOING ON VACATION, THE GOOD FOLKS AT KELLER PD WILL COME TO YOUR HOUSE. YOU GIVE THEM A NOTICE, AND THEN THEY'LL CHECK OUT YOUR HOUSE AND THEY'LL KIND OF GIVE A LITTLE ONCE OVER TO MAKE SURE WHILE YOU'RE ON VACATION, THE STIPULATIONS ARE THAT YOU HAVE TO BE GONE FOR AT LEAST THREE DAYS, BUT NO MORE THAN 21. AND I KNOW CHIEF FORTUNE IS HERE. I DON'T THINK YOU'RE ACTUALLY GOING TO PERSONALLY GO TO EVERY HOUSE. IS THAT CORRECT? YOU PERSONALLY, NOT YOU. OKAY, JUST MAKING SURE. COME ON CHIEF. YEAH. BUT NO, NO, THEY'VE GOT GREAT FOLKS WHO ARE GOING TO COME OUT THERE. SO AGAIN, IF YOU HAVE ANY QUESTIONS ABOUT THAT, PLEASE, PLEASE HEAD TO OUR WEBSITE AND CHECK OUT YOUR EMAIL, THE LATEST WESTLAKE WIRE. FOR ALL THAT INFORMATION AND TWO OTHER THINGS I WANT TO TALK ABOUT A QUICK LITTLE RECAP OF OUR CONCERT. OUR FINALE. OUR FINAL CONCERT OF THE YEAR. WE HAD ABOUT 500 PEOPLE, WHICH WAS A RECORD BY FAR. IT WAS A GREAT TURNOUT. WE APPRECIATE YOU GUYS WHO SHOWED UP AND CHECKED OUT ALL THE PICTURES AND THE VIDEOS. I MEAN, IT WAS IT'S A TOUGH ACT TO FOLLOW, LITERALLY. I MEAN, OUTSIDE OF THE REAL TAYLOR SWIFT. NEXT TIME, I DON'T KNOW HOW WE'VE SET THE BAR PRETTY HIGH NOW, SO IT'S WE'RE GOING TO HAVE TWO MORE COMING UP IN IN APRIL IN OUR SPRING. SO WE'RE GOING TO WE'RE GOING TO SEE IF WE CAN TOP THAT ONE. SO THANKS TO ALL THE RESIDENTS AND EVERYBODY WHO SHOWED UP TO THAT. AND THEN FINALLY, I WANT TO DO A KIND OF ECHO THE VETERANS DAY, WE TALKED ABOUT TODD AND WADE, BUT ALSO ADAM COFFEY ON OUR PLANNING AND ZONING COMMISSION. [00:20:06] HE IS AN ARMY VETERAN AND FIREFIGHTER, KYLE LYNCH, AS WELL, WHO WAS IN THE MARINES. SO WE WANT TO THANK THOSE GUYS AS WELL. THOSE ARE YOUR ITEMS OF COMMUNITY INTEREST. JON. THANK YOU. JUST A THING REAL QUICK. WE HAD A PLAYOFF FOOTBALL GAME SATURDAY AND WE WANT WESTLAKE ACADEMY ONE. WE HAD A GOOD GAME, BUT WE HAD THE OPPOSING TEAM HAD A COMPOUND FRACTURE. THE LEG WAS NOT MUCH FUN, BUT I GOT TO SEE CHIEF ART. I KNOW I SENT YOU A NOTE. I GOT TO SEE YOUR GUYS FIRSTHAND IN ACTION ONE. THE RESPONSE TIME WAS REALLY GOOD. PROBABLY 3911 CALLS, AND THEN WITHIN A FEW MINUTES. BUT THEY GOT THERE VERY QUICKLY. AND THEN JUST TO SEE THEM TAKE CARE OF THAT YOUNG MAN WAS REALLY GOOD. SO I'M REALLY PROUD OF THOSE GUYS. AND FIRST TIME I'VE GOTTEN TO SEE THEY WERE STRICTLY BUSINESS AND TOOK CARE OF HIM AND GOT HIM, GOT HIM IN GOOD SHAPE. SO THANK YOU VERY MUCH. THANK YOU. OKAY. AGENDA ITEM F PRESENTATIONS EXPLORING THE INTERNATIONAL BACCALAUREATE INQUIRY AT WESTLAKE ACADEMY. [F.1. Exploring the International Baccalaureate (IB): Inquiry at Westlake Academy (Michelle Briggs, Westlake Academy Director of Innovation and Development)] MICHELLE BRIGGS, WESTLAKE ACADEMY DIRECTOR OF INNOVATION AND DEVELOPMENT. HEY. GOOD AFTERNOON, MAYOR AND COUNCIL. THANK YOU FOR HAVING ME. THIS IS WE'VE GOT A VIDEO BEHIND. SO THIS IS THE VIDEO I DID SEND IT TO YOUR EMAIL, SO YOU MIGHT HAVE SEEN IT, BUT WE'RE HOPING YOU'LL SEE IT AGAIN. I ALSO WANTED TO GIVE AN UPDATE ON THE VIEWBOOK THEY GOT SENT OUT TO EVERY WESTLAKE RESIDENT. HOPEFULLY AS WESTLAKE RESIDENTS, YOU RECEIVED IT. I DON'T KNOW IN WHAT HOW THE USPS HANDLED YOUR DELIVERY, SO I WANTED TO ENSURE THAT YOU GOT TO YOU GOT A GOOD ONE, A GOOD CLEAN COPY. SO JUST WANTED TO GIVE THAT UPDATE. THIS THIS VIDEO IS GOING TO BE INQUIRY. SO WHAT INQUIRY LOOKS LIKE IN THE CLASSROOMS AT WESTLAKE ACADEMY FROM KINDERGARTEN THROUGH 12TH GRADE? AND ON DECEMBER 9TH, IT'LL BE A VIDEO ABOUT THE APPROACHES TO TEACHING. SO HOW WE TEACH WHAT IT LOOKS LIKE AT WESTLAKE ACADEMY VERSUS REGULAR SCHOOL. SO ENJOY. TURN IT UP A LITTLE. INQUIRY BASED EDUCATION IS A BASIC TENET OF THE IB PHILOSOPHY. IT REALLY CAPITALIZES ON THE NATURAL CURIOSITIES THAT KIDS HAVE. THIS INCREASES THEIR ENGAGEMENT, AND IT ALSO ENCOURAGES STUDENTS TO TALK, TO INTERACT, TO DISCUSS THEIR LEARNING. HANDS ON, INQUIRY DRIVEN CURRICULUM IS ESSENTIAL FOR OUR KIDDOS. IT REALLY HELPS OUR STUDENTS FIGURE OUT THE WHY BEHIND BIGGER PICTURE QUESTIONS. I NEED YOU TO IDENTIFY IF THERE'S A RIGHT ANGLE AND IF SO, WHERE IS IT? RIGHT HERE. I SEE SOME OF YOU HAVE MINI TRIANGLES. WHAT IS THE PURPOSE OF THIS EXERCISE? TO GAIN NEW PERSPECTIVES AND IDEAS. I COULD STAND HERE AND TALK TO YOU ALL DAY. THAT IS NOT REALLY AS VALUABLE AS THESE DISCUSSIONS AMONG YOURSELF. IT'S BEEN THROUGH SOMETHING LIKE THAT. I MEAN, THEY HAVE LOOKED LIKE THE GRANDPARENTS AND STUFF LIKE THAT WITH OUR FOOD AND STUFF. GUIDING QUESTION FOR TODAY WAS, DID THE SOLUTE DISAPPEAR WHEN MIXED INTO THE SOLUTION? I GIVE THEM THE GUIDING QUESTION, BUT FROM THERE, IT'S REALLY UP TO THEM AND THEIR TEAM TO FIGURE OUT HOW TO ANSWER THAT QUESTION. THEY COLLECT THEIR DATA, THEY MAKE OBSERVATIONS, THEY USE SCIENTIFIC TOOLS. AND THE TOOLS ARE DIFFERENT IN EVERY INQUIRY. SO STUDENTS ARE REALLY ALLOWED TO INVESTIGATE WHATEVER CONCEPT WE'RE LEARNING THROUGH THE LENS OF COLLABORATION. YOU LIKE MEASURED TABLESPOONS OURSELVES, AND SHE LET US POUR IT INTO THE WATER OURSELVES AND MIX IT. WELCOME TO THIRD GRADE, WHERE WE ARE ASKING OUR STUDENTS TO SOLVE THE PROBLEM OF HOW DO WE GET WESTWARD EXPLORERS INTO TEXAS, AND THEY HAVE TO CROSS A RIVER USING ONLY THE SUPPLIES THAT WE HAVE OFFERED TO THEM. AND THERE'S NO HELP FROM TEACHERS. THEY HAVE TO COLLABORATE AS A TEAM. THEY HAVE TO COME UP WITH A BUDGET. THEY HAVE TO FIGURE OUT WHAT MATERIALS THEY'RE GOING TO USE, AND THEN THEY HAVE TO PLAN THEIR DESIGN AND SEE IF IT'S GOING TO WORK OR NOT WORK. THEY HAVE TO TEST THEIR HYPOTHESIS, AND EACH PERSON IN THE GROUP HAS A JOB, AND EVERYBODY HAS TO BE INVOLVED IN THE PROJECT. THEN MARCH 31ST. GLUE. GLUE ON. GLUE. STICK OR LIQUID GLUE? WHAT DO YOU THINK WOULD BE BETTER? OKAY, WE'RE AT IT. WHAT'S NEXT? AND IT ALLOWS THEM TO CREATE VISIBLE EVIDENCES OF WHAT THEY'RE LEARNING. AND IT CHALLENGES THEM TO THEN TAKE THAT LEARNING AND TRANSFER IT TO LOCAL AND GLOBAL IMPLICATIONS. MY FAVORITE PART IS THE BEGINNING OF THE BUDGET, BECAUSE I'VE ALWAYS LIKED MATH AND STUFF. [00:25:05] SO YEAH, I LEARNED THAT WHEN YOU MAKE A RIDGE ON A PROJECT THAT YOU NEED TO MAKE STABILIZERS. MY FAVORITE PART WAS MAKING THE BRIDGE SUPER STURDY. I REALLY LIKED THIS PROJECT BECAUSE I WANT TO BE AN ENGINEER. WE'RE USING REAL WORLD INQUIRY TO HAVE THE KIDS SOLVE A PROBLEM, AND WE'RE BRINGING IN THEIR MATH SKILLS, THEIR COMMUNICATION SKILLS, THEIR TESTING SKILLS, THEIR WRITING SKILLS. SO THEY'RE HAVING TO EXPERIMENT WITH ALL SORTS OF DIFFERENT WAYS TO SOLVE THIS PROBLEM. REALLY LEARNING HOW TO ASK THOSE QUESTIONS AND TO THINK AT A DEEPER LEVEL. AND THOSE SKILLS ARE CARRYING UP ALL THE WAY THROUGH THE MYP AND THEN ULTIMATELY TO THE DIPLOMA PROGRAM. AND WHAT YOU FIND WITH STUDENTS WHO COME OUT OF AN IB PROGRAM IS THEY ARE LEARNING AND THEY'RE ASKING QUESTIONS, AND THEY'RE CRITICALLY THINKING ON A DEPTH THAT MOST STUDENTS IN TRADITIONAL STYLES OF EDUCATION WOULD NOT BE ASKED TO DO, AND THAT SERVES THEM FOR THE REST OF THEIR LIVES. THEY'LL BE BETTER THINKERS. THEY'LL BE BETTER CONSUMERS OF INFORMATION. THEY'LL KNOW HOW TO PROCESS DIFFERENTLY BECAUSE THEY'VE BEEN TAUGHT HOW TO QUESTION THINGS, AND THEY'VE BEEN GIVEN REALLY THE AUTONOMY TO DO THAT. WASN'T GOING TO LEAVE THIS TIME. ANY OTHER QUESTIONS? ALL GOOD. THAT'S SO WELL DONE. THANK YOU. YOU KNOW WHAT, YOU GUYS THE MOMENTUM OF THE SCHOOL THAT I'M SEEING AND TALKING TO THE TEACHERS AND THE VIEWBOOK, AND AS I GET OUT, I'M TRYING TO SPEAK AT EVERY ENGAGEMENT I CAN, AND, YOU KNOW, KIND OF DO THE JOB OF MAYORS TO PROMOTE THE TOWN AND SCHOOL. BUT I'M JUST SO PLEASED WITH WHAT'S GOING ON AT THE ACADEMY AND THE MOMENTUM WE HAVE AND ALL OF THE STUFF Y'ALL ARE I JUST CAN'T THANK YOU ENOUGH. AND THE OTHER THING I'D SAY, I CAN'T REMEMBER WHEN I WAS IN THIRD AND FOURTH GRADE, WE WEREN'T DOING THAT. AND THAT KID THAT SAYS HE KNOWS HE WANTS TO BE AN ENGINEER AT FOURTH GRADE, GOD BLESS HIM. THAT'S REALLY GOOD. ANY COMMENTS OR THOUGHTS? WELL DONE. THANKS. [F.2. Presentation regarding Water System Lead and Copper Testing (Cheryl Taylor, P.E., Public Works Director)] AGENDA ITEM F2 20 4-36 FOR PRESENTATION REGARDING WATER SYSTEM LEAD AND COPPER TESTING. HI, CHERYL. GOOD EVENING. NOT AS EXCITING AS THE IB VIDEO. OKAY, SO TO GIVE YOU ALL SOME BACKGROUND INFORMATION ON LEAD AND COPPER TESTING, ALL CITIES ARE ON AN ANNUAL MONITORING REQUIREMENT WITH TCEQ FOR LEAD AND COPPER. FREQUENCIES ARE DIFFERENT WITH EACH OF THE CITIES DEPENDING ON PARAMETERS SUCH AS PAST TESTING RESULTS AND THE TESTING FREQUENCY IS DIRECTED BY TK. THE TOWN OF WESTLAKE IS ON A ONE YEAR ANNUAL REDUCED MONITORING CYCLE, WHERE SAMPLES ARE COLLECTED FROM TEN SITES. THE REDUCED MONITORING PERIOD IS A DEFINED PERIOD BETWEEN JUNE 1ST AND SEPTEMBER 30TH. THE CITY OF ROANOKE PROVIDES TESTING SERVICES FOR THE TOWN, AND THEY NOTIFIED STAFF OF THE LEAD LEVEL EXCEEDANCE. SO THE TCEQ NOTIFIED STAFF BY EMAIL ON OCTOBER 25TH THAT THE TOWN OF WESTLAKE EXCEEDED THE LEAD ACTION LEVEL ON MORE THAN 10% OF THE WATER SAMPLES TAKEN DURING THE LEAD AND COPPER TAP MONITORING PERIOD. WHAT THAT MEANS IS THE LEAD LEVEL WAS MORE THAN 0.015MG/L ON TWO OF THE TEN REQUIRED SAMPLES THAT WERE COLLECTED THIS YEAR. SO IF IT WAS, IF IT WAS ONLY ONE SAMPLE, THEN IT WOULD HAVE BEEN 10%. BUT THE FACT THAT TWO OF THEM EXCEEDED THAT GOT US OVER THE 20%, WHICH BY DEFINITION MEANS THAT WE HAVE EXCEEDED THE LEAD LEVELS FOR THE TOWN. SO THE ACTUAL LEVEL EXCEEDANCE HIGHWAY IS THE EXHIBIT THAT WE THAT WE GOT FROM THE TC WEBSITE. IT OUTLINES THE STEPS THE TOWN IS REQUIRED TO TAKE OVER THE NEXT YEAR. THIS IS THE ROADMAP TO ACHIEVE COMPLIANCE AND RESUME THAT THAT REDUCED MONITORING OF ONCE PER YEAR. SO WITHIN THE FIRST 30 DAYS, THE TOWN IS REQUIRED TO NOTIFY THE PROPERTY OWNERS THAT THE TEN SAMPLE LOCATIONS OF THE RESULTS. THOSE RESULTS HAVE BEEN DELIVERED AS REQUIRED. DUE TO THE EXCEEDANCE, THE TOWN WILL BE REQUIRED TO SEND A NOTICE TO ALL WATER CUSTOMERS IN THE TOWN, LETTING THEM KNOW OF THE LEAD EXCEEDANCE. SO THAT'S FORM 20681, AND IT'S REQUIRED WITHIN THE FIRST 60 DAYS. THE TOWN WILL ALSO NEED TO BEGIN WATER QUALITY PERIMETER MONITORING. [00:30:01] THESE ARE THE MOST TIME SENSITIVE DUE DATES THE STAFF IS CURRENTLY WORKING ON. THAT'S THE LEAD. PUBLIC EDUCATION THAT'S DUE ON NOVEMBER 30TH. AND THEN TWO DISTRIBUTION WATER QUALITY PARAMETER SAMPLES AND THEN ONE ENTRY POINT WATER QUALITY SAMPLE. SO THIS IS THAT FORM 20681A. IT'S A FORMAL LETTER. IT'S A FILLABLE FORM. AND IT IS REQUIRED TO BE SENT TO ALL OF ALL OF THE WATER CUSTOMERS IN THE TOWN. SO BECAUSE IT'S SUCH A TECHNICAL FORM, WE HAVE PROVIDED, WE HAVE PREPARED A COVER LETTER AND WE'RE INTENDING TO SEND THIS OUT BY NOVEMBER 18TH BEFORE THE NOVEMBER 30TH REQUIREMENT. THIS HAS BEEN THIS LETTER, OUR COVER LETTER. AND THEN THAT FORM HAVE BOTH BEEN SENT TO TC BECAUSE THEY REQUIRE THAT THE TOWN SEND IT TO THEM AND THEY WILL APPROVE IT. ONCE IT'S APPROVED, WE WILL SEND IT TO THE PRINTERS AND START STUFFING ENVELOPES AND SEND IT OUT. SO ANOTHER IMPORTANT DEADLINE IT'S A LITTLE FURTHER AWAY IS THE CORROSION CONTROL STUDY STAFF HAS REACHED OUT TO HARDEN AND ASSOCIATES TO HELP FACILITATE THE EFFORT. THE STUDY IS REQUIRED TO BE SUBMITTED WITHIN 12 MONTHS FROM THE END OF THE MONITORING PERIOD AND THEN IN OH, AND IN 2021, THE TOWN OF WESTLAKE HAD CONTRACTED WITH HARDEN AND ASSOCIATES TO DO THE SAME PERFORM THE SAME TASKS. NEXT ACTION ITEM ENTRY POINT SAMPLING. THE TOWN IS CONTRACTING WITH CAIRO ENVIRONMENTAL TO PULL THE ENTRY. ENTRY POINT SAMPLES. THEY'LL MEET WITH STAFF ON SITE AT THE PUMP STATION ON WEDNESDAY OF THIS WEEK TO PULL THE FIRST REQUIRED ENTRY POINT SAMPLE AND SEND IT IN TO AN APPROVED TCEQ LABORATORY FOR TESTING IN ORDER TO MEET THE FIRST CRITICAL DEADLINE OF NOVEMBER 30TH. THREE ADDITIONAL SAMPLES WILL BE TAKEN BY CAIRO ENVIRONMENTAL WITHIN THE TIMEFRAMES NOTED HERE ON THE SLIDE. CAIRO ENVIRONMENTAL WILL ALSO BE PERFORMING THE DISTRIBUTION SYSTEM SAMPLING FOR THE TOWN ON WEDNESDAY. ON WEDNESDAY AS WELL. SO ON THE ONE YEAR SAMPLING CYCLE, THE TOWN TAKES SAMPLES AT TEN OF THE 24 APPROVED TCEQ LOCATIONS ANNUALLY. BECAUSE OF THE EXCEEDANCE, THE TOWN OF WESTLAKE IS REQUIRED TO COLLECT 20 SAMPLES TWICE THIS YEAR WITHIN THE TIME FRAME SHOWN ON THE SLIDE FOR NEXT YEAR. CYCLE. HARDIN AND ASSOCIATES WILL BE COLLECTING THE SAMPLES. THEY'LL BE SAMPLING THE SAME LOCATIONS THAT CAUSED THE EXCEEDANCE, AND THEY WOULD DELIVER THEM TO A TCEQ APPROVED LABORATORY. AND THEY WILL SUBMIT ALL OF THAT PAPERWORK TO T-C-EQ AS REQUIRED ON BEHALF OF THE TOWN OF WESTLAKE. WE'VE PREVIOUSLY MENTIONED A PARTNERSHIP WITH THE EPA CALLED THE GLO INITIATIVE, OR THE GET THE LEAD OUT INITIATIVE, AND NO COST TO THE TOWN. THE EPA PROVIDED A CONSULTANT TO WORK WITH THE TOWN ON THE REQUIRED SERVICE LINE INVENTORY. INVENTORY WAS SUBMITTED TO THE EPA ON OCTOBER 11TH AHEAD OF THE OCTOBER 16TH DEADLINE. THE SLIDE SHOWS THAT BASED ON THEIR INVESTIGATIONS, THERE ARE NO LEAD SERVICE LINES WITHIN THE TOWN OF WESTLAKE. THIS IS BASED ON TARRANT AND DENTON. EXCUSE ME. DENTON COUNTY APPRAISAL DISTRICT DATA TO DETERMINE THE BUILD DATE ON EACH STRUCTURE. SITES CONSTRUCTED PRIOR TO 1988, BEFORE THE LEAD BAN, WERE FIELD VERIFIED BY A CONTRACTOR THROUGH THE GLOW INITIATIVE, AND WERE DETERMINED TO BE NON-LED. WHAT THAT TELLS US IS THAT THERE IS NO LEAD ON THE CITY SIDE OR ON THE SERVICES. THAT LEADS US TO BELIEVE THAT ANY TRACES OF LEAD IN THE SAMPLING IS LIKELY FROM THE PLUMBING AND OR FIXTURES INSIDE THE OLDER HOMES. SO WOULD YOU SAY THAT AGAIN? SO BASED ON THE DATA THAT WAS COLLECTED AND THE FIELD INVESTIGATIONS, THERE IS NO LEAD ON THE CITY SIDE OR ON THE SERVICE LINES. SO THAT WHAT THAT MEANS THEN IS THAT THE TRACES OF LEAD THAT ARE FOUND IN THE SAMPLING IS LIKELY FROM THE PLUMBING OR THE FIXTURES INSIDE THE OLDER HOMES, THE TWO HOMES THAT TESTED POSITIVE FOR LEAD WERE OLDER, WERE BUILT BEFORE THE 80S. THAT WAS ONE OF THE QUESTIONS I HAD. HOW MANY HOMES ARE WE TALKING ABOUT? TWO. TWO THAT WERE TESTED. SO ANOTHER QUESTION I HAVE IS IF THE LEAD IS COMING FROM THOSE HOMES AND IS IT GOING BACK INTO OUR SEWAGE AND DOES IT THROUGH THE WATER PROCESSING COME BACK OUT, YOU KNOW, IS IT GOING TO POLLUTE THE SYSTEM, I GUESS, IS MY QUESTION OR NO, WHEN IT COMES BACK FROM OUR SERVICE SIDE, IF IT'S NOT IN OUR SERVICE SIDE, THAT MEANS IT'S NOT BEING DISTRIBUTED. CORRECT. WE'RE NOT AWARE OF IT BEING BACK INTO IN THE SYSTEM, BUT A PROACTIVE APPROACH WOULD BE TO TAKE CARE OF THOSE HOMES THAT, YOU KNOW, THAT IT'S COMING FROM. BUT BECAUSE YOU'RE TESTING THE DISTRIBUTION LINES AND THERE'S NONE IN THE DISTRIBUTION LINES, THAT MEANS IT'S NOT AS TO OUR KNOWLEDGE, IT'S NOT GOING INTO IT'S NOT GOING TO ANY WATER IS NOT WITH LEAD IS NOT BEING DISTRIBUTED TO ANY AS FAR AS WE KNOW. [00:35:02] IF WE WERE TO LOSE WATER PRESSURE, THERE WOULD BE A POSSIBILITY THAT IT COULD BACKFLOW INTO THE SYSTEM. CAROL. THAT MEANS THAT THE TESTING THAT WAS DONE, THE TWO FAILURES WERE NOT DONE ON THE FRESHWATER SIDE, THE INTAKE, BUT THEY WERE DONE ON THE WASTE SIDE. THEY ARE TAKEN BY THE PROPERTY OWNERS INSIDE THE HOMES. LET ME SINCE YOU BRIEFED US ON THIS, I THINK WHAT WE'RE GETTING AT IS I UNDERSTOOD FROM OUR CONVERSATION EARLIER YOU TESTED OUR INPUTS AND EXPERT AND DETERMINED THAT THE LEAD WAS BEING CONTAMINATED. INSIDE. THE PLUMBING OF THE HOME IS NOT BEING DISTRIBUTED BY WESTLAKE. AND UNLESS WE HAVE A SEVERE DROP IN WATER PRESSURE, WESTLAKE WOULD NOT BE DISTRIBUTING LEAD INTO ANY HOMES. IS THAT FAIR? THAT IS FAIR. THAT'S FAIR. SO THE EPA'S WEBSITE AT EPA.GOV./SAFE WATER IS A GOOD RESOURCE FOR WATER CUSTOMERS THAT ARE INTERESTED IN READING MORE ABOUT IDENTIFYING SOURCES OF LEAD AND WHAT CUSTOMERS CAN DO TO PROTECT THEMSELVES. HAPPY TO ANSWER ANY QUESTIONS. WHAT DO WE DO TO HELP THESE HOMEOWNERS, IF ANYTHING? I MEAN, IT'S BEEN IDENTIFIED. WHAT IS THEIR PATH FOR REMEDIATION TO GET THIS TAKEN CARE OF? WOULD YOU LIKE ME TO ANSWER? SURE. OKAY. MR. MAYOR AND COUNCIL, THANK YOU VERY MUCH FOR TAKING THE TIME FOR THE PRESENTATION TONIGHT. PUBLIC WORKS DID AN OUTSTANDING JOB. AS I STATED BEFORE, WE TESTED THAT WATER SUPPLY ON BOTH SIDES OF OUR METER. RIGHT. WHICH MEANS THE FRESHWATER COMING INTO THAT METER WAS CLEAN. THE FRESHWATER ON THE OTHER SIDE OF OUR METER WAS CLEAN. THE SAMPLE THAT WAS TAKEN FROM INSIDE THE HOME WAS THE ONE THAT WAS POSITIVE FOR LEAD. SO AS LONG AS WE CONTINUALLY HAVE WATER PRESSURE, WE DON'T HAVE ANY WORRIES OF LEAD FROM THE HOME GETTING BACK INTO OUR FRESHWATER SUPPLY SO THAT THAT'S A GOOD ASPECT OF THE TEST. AND ONLY TWO OF THE TEN HOMES THAT WERE TESTED WERE POSITIVE. THOSE WERE BOTH OLDER HOMES. SO WHAT TO YOUR QUESTION, MAYOR, WHAT WE'RE DOING IS WE WOULD LIKE TO BRING FORWARD WITH COUNCIL. WE'D LIKE TO USE SOME OF THE TOWN'S MONEY TO DO A REIMBURSEMENT PROGRAM FOR HOMEOWNERS WHO WOULD LIKE TO HAVE HOMES THAT ARE A CERTAIN AGE, RIGHT. THAT FALL BEFORE 1983, IF THEY HAVE SOME OF THESE OLDER FIXTURES, WE'D LIKE TO HELP SOME OF THOSE FOLKS CHANGE OUT SOME OF THOSE FIXTURES. SO WE'LL BE BRINGING FORWARD SOMETHING TO COUNCIL TO APPROVE WITHIN THE NEXT MONTH, PROBABLY AT THE NEXT MEETING, TO LOOK AT A POSSIBILITY OF HELPING THOSE FOLKS OUT, BECAUSE A LOT OF THOSE FOLKS THAT OWN THOSE OLDER HOMES BUILT BEFORE 1983 ARE ON A SET INCOME, RIGHT? AND THEY DON'T HAVE THE MEANS TO GET THIS DONE. SO WE'LL HELP THEM FIND A PLUMBER. WE'LL HELP THEM WITH A REIMBURSEMENT OF SOME OF THOSE COSTS IN ORDER TO MAKE THAT HAPPEN. EXCELLENT. WADE, DON'T YOU WOULD IT BE SMART, MAYBE TO MAKE SURE THAT WE DO AN ASSESSMENT ON THE HOME, BECAUSE MY CONCERN IS LEAD SOLDER AND THE OTHER ITEMS THAT CAN ACTUALLY GENERATE LEAD INTO A SYSTEM OTHER THAN JUST A PURE FIXTURE. YES, SIR. IT'S NOT SOMETHING THAT WE CAN DO OURSELVES, RIGHT? BUT WE WILL ENCOURAGE THEM AND CONNECT THEM WITH THOSE BECAUSE THEY COULD. WE COULD CHANGE THE FIXTURES, SPEND MONEY. THEY GOT BRAND NEW BEAUTIFUL FIXTURES. THAT'S EXACTLY RIGHT. AND THEY'RE STILL GOING TO GET LEAD IN THE SYSTEM IF THERE'S LEAD SOLDER IN THE EXISTING. YES SIR. PART OF THE PROGRAM AND WE'LL GIVE THE DETAILS OF THE PROGRAM. BUT AS WE'VE BEEN TALKING ABOUT IT WITH PUBLIC WORKS TEAM, PART OF THAT WOULD BE YOU HAVE TO SHOW US A POSITIVE TEST. ONCE WE SEE A POSITIVE TEST FROM YOUR FACILITY, YOU NEED TO SHOW THEM THAT YOU NEED OUR HELP IN GETTING THOSE THINGS DONE. AND THEN WE WOULD LIKELY BE ABLE TO DO SOME TYPE OF A REIMBURSEMENT GRANT OR SOMETHING LIKE THAT FROM THE TOWN TO HELP THESE FOLKS OUT. I KNOW THERE'S A FORMAL LEAD ABATEMENT PROCESS THAT PLUMBERS USE TO GO IN AND LOOK AT THE HOMES. YES. FROM THE PIPING, THE FIXTURES, THE SOLDER. AS A TOWN, WE CAN'T TELL YOU WHAT PLUMBER TO USE. RIGHT. BUT WE CAN GIVE YOU A LIST OF PLUMBERS THAT THEY CAN DO THAT. BUT OUR GOAL IS TO HELP THESE PEOPLE FIND A WAY TO. TO GET THAT IT'S NOT HEALTHY FOR THEM. IT'S NOT GOOD FOR THE WATER SUPPLY. IF WE WERE TO HAVE SOME KIND OF A CATASTROPHIC EMERGENCY. HAS THIS EVER HAPPENED IN WESTLAKE BEFORE? TO OUR KNOWLEDGE, IT HAS. IT HAS IN 2000, I BELIEVE IT WAS 2000. 21 WAS THE FROM THE RECORDS THAT WE WERE ABLE TO FIND, IT HAPPENED IN 2021. I DON'T KNOW BEFORE THAT. OKAY. I'M GOING TO ASK YOU A VERY UNFAIR QUESTION. WHAT IS THE PROBABILITY THAT WE WOULD LOSE WATER PRESSURE? THAT'S A GREAT QUESTION. SO WITH OUR CURRENT SYSTEM IN PLACE, WE KNOW THAT WE HAVE ABOUT 6.5 HOURS TO FIX ANY TYPE OF MAJOR LEAK IN ORDER TO GET THIS DONE. SO YOU'RE LOOKING AT THE MAN WHO I'M LOOKING AT HIM RIGHT NOW. RIGHT. SO WE ALREADY KNOW THAT WE'VE GOT ABOUT SIX HOURS TO GET A MAJOR LEAK FIXED OR SOMEHOW GET PRESSURE BACK ON THE SYSTEM. CHERYL, THIS IS A I. PLEASE CORRECT MY UNDERSTANDING AND THEN USE THIS OPPORTUNITY. BUT I THINK WE HAVE BACKFLOW PREVENTERS ON OUR IRRIGATION SYSTEMS. I DON'T KNOW IF WE DO ON OUR MAIN SYSTEMS, BUT WOULD YOU WANT TO USE THIS OPPORTUNITY TO CONFIRM THAT AND REMIND HOMEOWNERS IN WESTLAKE WHAT OUR RESPONSIBILITIES ARE FOR TESTING THOSE BACKFLOW SYSTEMS? I BELIEVE THE REQUIREMENT IS ONCE A YEAR, AND IRRIGATION SYSTEMS ARE TYPICALLY REQUIRED TO HAVE A BACKFLOW. [00:40:07] DO WE EVER CHECK THOSE SYSTEMS? I KNOW THAT MY SPRINKLER COMPANY DOES A BACKFLOW TEST. DOES THE CITY EVER TEST THOSE? THERE'S A BACKFLOW PREVENTION. WHAT IS IT? DO WE. GOOD EVENING. YES. WE CONTRACT FOR BACKFLOW PREVENTION, AND WE TEST ANNUALLY SO THAT THAT SERVICE IS BEING PERFORMED. EACH ACCOUNT FOR EACH BACKFLOW DEVICE. OKAY. GOOD. THANKS, KYLE. ANY OTHER QUESTIONS? I WOULD LIKE TO SAY THAT ON THE HARDENING ASSOCIATES, THEY'RE GOING TO THESE HOMES THAT HAVE TESTED POSITIVE OR THAT ARE ON THIS LIST. WE'RE GOING TO DO A CSI, CUSTOMER SERVICE INSPECTION TO VALIDATE THE LIST. FIND IT, TO ROUTE IT OUT TO GET IT MITIGATED. THAT IS GREAT TO HEAR. WHAT WE SHOULD DO. PERFECT. ANY OTHER QUESTIONS? COMMENTS? CHERYL. ANYTHING ELSE? THANK YOU. AGENDA ITEM G, CONSENT AGENDA. [G. CONSENT AGENDA] DOES ANYBODY HAVE ANY OF THE CONSENT AGENDA THEY WOULD LIKE TO DISCUSS? I TAKE THAT AS A NO. CAN I GET A MOTION TO APPROVE THE CONSENT AGENDA? SO MOVED. CAN I GET A SECOND? SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? MOTION CARRIES. THANK YOU VERY MUCH. OUR REGULAR AGENDA ITEMS. [H.1. Discuss, consider and act to approve Resolution 24-74 accepting the Town of Westlake 2023 Audit Report; and take appropriate action (Cayce Lay Lamas, Director of Finance)] RESOLUTION 24-74. DISCUSS. CONSIDER AN ACT TO APPROVE RESOLUTION 24-74, ACCEPTING THE TOWN OF WESTLAKE 2023 AUDIT REPORT AND TAKE APPROPRIATE ACTION, STACY. MAKE THIS A LITTLE TALLER. I HAVE ON MY HEELS TODAY. ALL RIGHT. THIS IS OUR FISCAL YEAR 23 TOWN AUDIT. SO THIS IS THE ENDING FINANCIAL REPORT FOR THE PERIOD FROM OCTOBER 1ST OF 2022 THROUGH SEPTEMBER 30TH, 2023. IT IS MUCH LATER THAN WE WOULD HAVE PREFERRED. THAT IS IN PART BECAUSE OF OUR UNIQUE STRUCTURE. WE HAVE TO INCLUDE THE ACADEMY'S FINANCIALS, WHICH WERE DELAYED BECAUSE OF THE ERP IMPLEMENTATION ON THEIR SIDE. YOU WERE SENT A DRAFT. WE ALSO HAVE OUR AUDITORS AND LEWIS BREEDLOVE AND AUSTIN HENDERSON FROM BROOKS WATSON. THEY'RE PREPARED TO DO A PRESENTATION IF YOU'D LIKE TO GO THROUGH DETAILS ON THIS, BUT THE HEADLINE FOR FISCAL YEAR 23 ON THE TOWN SIDE IS THAT OUR NET POSITION INCREASED BY $17.5 MILLION. AND SPECIFICALLY IN THE GENERAL FUND, WE HAD AN INCREASE OF ABOUT $9.7 MILLION TO OUR FUND BALANCE, WHICH GIVES US AN ENDING FUND BALANCE OF 30.8 MILLION, WHICH IS PRETTY SIGNIFICANT FOR OUR RESERVE STATUS. AND THE AUDITS THE THEY WERE UNQUALIFIED CORRECT, UNMODIFIED OPINION. YES, SIR. YEAH. ANY QUESTIONS? I WANT TO GO THROUGH THE DETAIL OR IS THERE IS THERE ANY NEED ANYBODY WANTS TO GO THROUGH THE DETAIL? I THINK WE ALL READ IT AND I APPRECIATE THE QUESTIONS, CASEY, THAT YOU ANSWERED FOR THE MEETING. I MEAN, JUST FOR RESIDENTS SAKE. I MEAN, NOT FOR RESIDENTS WHO MIGHT BE VIEWING NOT THINK WE TAKE THIS LIGHTLY. I THINK WE READ 200 PAGES OF AUDITS. THANK YOU. WE DID. AS FAR AS FOR ME AND I KNOW OTHER COUNCIL MEMBERS, WE DID READ IT AND HAVE A CHANCE TO TALK WITH CASEY ABOUT SOME OF OUR QUESTIONS. SO FOR MY PART, I DON'T NEED ADDITIONAL DETAIL. YEAH. AND LOOK, I THINK THE JUST, IN ALL HONESTY, KIND OF THE PERFECT STORM WITH WHAT HAPPENED WITH OUR MUNICIPALITY, WITH OUR STAFF WITH SOME OTHER ENTITIES THAT WE COULDN'T. SO IT'S NORMALLY NOT THIS LATE. WE ARE ON TRACK NOW. WE WILL BE ON OUR NORMAL SCHEDULE GOING FORWARD. CORRECT. CORRECT. OKAY. WE DON'T NEED. GENTLEMEN, THANK YOU FOR BEING HERE. AND I KNOW WE GOT ANOTHER ONE COMING UP, BUT WE DON'T NEED TO TAKE YOU ALL THROUGH OR THE COUNCIL THROUGH IT. SO CAN I GET A MOTION TO APPROVE RESOLUTION 24-74? PENDING THE DATED LETTER FOR TODAY, ON THE MOTION, WE WOULD JUST ASK THAT COUNCIL ACCEPT PENDING THE FINAL AUDIT LETTER. RESOLUTION 24-74, PENDING THE FINAL AUDIT LETTER. YES, SIR. CAN I GET A MOTION? SO MOVED. SECOND. GET A SECOND. ALL IN FAVOR? AYE. AYE. ANY OPPOSED? MOTION CARRIES. CASEY. [H.2. Discuss, consider and act to approve WA Resolution 24-40 Approving the FY 2023-2024 Annual Financial Report for Westlake Academy from BrooksWatson & Co., PLLC, CPAs (Cayce Lay Lamas, Finance Director)] RESOLUTION 24-40. DISCUSS, CONSIDER AND APPROVED [INAUDIBLE] RESOLUTION 24-40 APPROVING THE FY 2023-2024 ANNUAL FINANCIAL [00:45:04] REPORT FOR WESTLAKE ACADEMY FROM BURKE, WATSON AND COMPANY. AND THIS IS WHERE WE GET BACK ON OUR NORMAL SCHEDULE. SO TEA REQUIRES THAT AUDITS ARE PRESENTED WITHIN THE FIRST 150 DAYS AFTER THE FISCAL YEAR ENDS. SO THAT WOULD BE JUST HERE IN A COUPLE OF WEEKS. SO BY ACCEPTING THE ACADEMY'S AUDIT TODAY, AS I SAID, THAT PUTS US BACK ON SCHEDULE SO THAT WE CAN ADOPT OR ACCEPT THE FISCAL YEAR 24 TOWN AUDIT IN MARCH OF THIS UPCOMING YEAR AND ON THIS ONE, VERY SIMILAR. WE HAD A NET POSITION INCREASE OF $346,000. THE GENERAL FUND BALANCE INCREASED $720,000 FOR AN ENDING FUND BALANCE OF 1.9 MILLION. AND THEN AGAIN, WE HAVE LEWIS AND AUSTIN HERE. IF WE HAVE ANY SPECIFIC QUESTIONS ON THE ACADEMY'S AUDIT. PATH. YEAH. I JUST ALSO NOTE FOR CITIZENS, I DON'T I DON'T KNOW WHAT A CITIZEN COULD DO IF THEY WANTED TO SEE THE AUDIT, BUT I CAN SAY THAT WE'VE SEEN IT AND READ IT. AND I FEEL COMFORTABLE HAVING ASK YOU QUESTIONS OFFLINE. SO THANK YOU. THESE AUDITS ARE ONLINE, ARE THEY NOT? THEY WILL BE THIS WEEK WHEN THEY'RE DONE. AFTER THEY'RE ACCEPTED. YES, SIR. YEAH. AND LOOK, I JUST WANT TO SAY TO THIS COUNCIL AGAIN, I KNOW I'VE SAID THIS A COUPLE OF TIMES. THE REASON THESE MEETINGS ARE RUNNING WELL IS THE TIME THAT YOU ALL ARE PUTTING INTO THEM, AND THE TIME THAT WADE, YOU AND CASEY ARE TAKING TO ANSWER THESE QUESTIONS. WE GET THROUGH THESE AND THE LINE OF QUESTIONS ON THE AUDIT WAS PRETTY EXTENSIVE FROM SEVERAL COUNCIL MEMBERS. SO I REALLY DO APPRECIATE THAT. WE APPRECIATE THE INTEREST. YEAH. CAN I GET A MOTION TO APPROVE RESOLUTION 24-40? SO MOVED. I GET A SECOND. SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? MOTION CARRIES. YOU GUYS, THANK YOU. AND I JUST WANTED TO TAKE A SECOND TO SAY THANK YOU ALL. YOU GUYS HAVE AN EXCELLENT TEAM HERE, BOTH ON THE TOWN AND ACADEMY SIDE. THEY WORK THEIR BUTTS OFF TO GET THIS STUFF DONE. AND JUST OUR CONTACT INFORMATION IS IN THAT IN THE PACKET. SO IF YOU GUYS HAVE ANY QUESTIONS, PLEASE DON'T HESITATE TO REACH OUT TO US. YOU CAN ALWAYS GO TO CASEY OR MARLENE. WE'RE AVAILABLE FOR YOU ALL AS WELL AS WE WORK. WE WORK FOR THE BOARD. WE WORK FOR THE COUNCIL. SO JUST WANTED TO MAKE SURE I MENTIONED THAT. AND THANK YOU. ALL RIGHT. THANK YOU VERY MUCH FOR BEING HERE AND WHAT YOU DO FOR US? THANK YOU. I THINK WE HAVE A MOTION TO TABLE RESOLUTION 24-78, RESOLUTION 24-79 YES, MAYOR. [H.3. Discuss, consider and act to cast the Town of Westlake’s allocated votes for appointment to the Tarrant Appraisal District Board of Directors (Wade Carroll, Town Manager)] I MOVED TO TABLE 24-78, 24-79 TO A FUTURE MEETING. OKAY. CAN I GET A MOTION TO TABLE RESOLUTION 2 478? I'LL MAKE THE MOTION. BUT MAY I ASK A QUESTION? YEAH. WHEN DO WE HAVE TO MAKE A DECISION? ON DECEMBER 9TH. THE NINTH. OKAY. YES, SIR. I HAVE A MOTION. DO I HAVE A SECOND? SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? RESOLUTION 24-79. [H.4. Discuss, consider and act to cast the Town of Westlake’s allocated vote for appointment to the Denton Central Appraisal District Board of Directors (Wade Carroll, Town Manager)] CAN I GET A MOTION TO TABLE RESOLUTION 2479? SO MOVED. GET A SECOND. SECOND. ANY OPPOSED? MOTION CARRIES. THAT WILL BE ON THE DECEMBER 9TH AGENDA. I THINK DIANA HAS A PROCEDURAL QUESTION FOR YOU. WHAT DID I ALL THOSE. OH, I DID. OH. ALL IN FAVOR? AYE. ANY OPPOSED? COME ON AGAIN. THANK YOU. I WAS JUST TESTING YOU. DIANA, ACTUALLY. OH, THERE YOU GO. OKAY. H-5, ORDINANCE 1012. [H.5. Discuss, consider and act to adopt Ordinance 1012, Amending the Master Fee Schedule (Cayce Lay Lamas, Director of Finance)] DISCUSS, CONSIDER, AND ACT ADOPTING ORDINANCE 1012. AMENDING THE MASTER FEE SCHEDULE. CASEY, YOU'RE BACK. SO THE MASTER FEE SCHEDULE. THIS IS A ROUTINE ANNUAL ITEM THAT WE BRING BEFORE COUNCIL JUST TO UPDATE ALL OF THE FEES THAT WE CHARGE FOR VARIOUS SERVICES. THERE ARE NO MATERIAL CHANGES FOR THIS ADOPTION TONIGHT. I WANT TO POINT OUT THAT IT DOES INCLUDE ANY FEES THAT ARE SPECIFICALLY SET BY STATE STATUTE. SO THAT INCLUDES OUR MUNICIPAL COURT FINES. IT ALSO INCLUDES, IT EXCLUDES THE UTILITY FEES, WHICH ARE GOING TO BE ADOPTED JUST AFTER THIS IN A SEPARATE ORDINANCE. AND EVERYTHING WITHIN THE MASTER FEE SCHEDULE PRESENTED TONIGHT WOULD BE EFFECTIVE JANUARY 1ST. RIGHT. AND AMONG THE UPDATES INCLUDED, THE MAJORITY OF THE UPDATES IN THE MASTER FEE SCHEDULE WERE GRAMMATICAL AND ORGANIZATIONAL. WE DID ADD TEMPORARY CERTIFICATE OF OCCUPANCY FEES AND VARIANCE REQUEST FEES, JUST BASED ON THE DEVELOPMENT CHALLENGES WE'VE BEEN EXPERIENCING. AND THEN WE UPDATED THE RENTAL FEE FOR COUNCIL CHAMBERS TO MATCH WHAT OUR ONLINE POLICY AND PRACTICE IS. AND THEN WE ALSO CODIFIED THE CEMETERY FEES THAT WERE APPROVED THROUGH RESOLUTION 20 407 EARLIER THIS YEAR. [00:50:03] ALL OF THESE CHANGES, WE DO NOT EXPECT ANY TYPE OF MATERIAL REVENUES TO COME IN. WE'RE NOT PROJECTING ANY INCREASES TO BUDGET. A LOT OF THESE, AS I SAID, ARE EITHER ADMINISTRATIVE AND WE'VE ALREADY BEEN CHARGING THEM OR REALLY IT'S JUST RESPONSIVE AND HOPEFULLY GOING TO HELP DEVELOPERS KEEP THINGS MOVING. EXCELLENT QUESTION, CASEY. MAYBE FROM OUR RECENT EXPERIENCE, DO YOU HAVE ADEQUATE ABILITY TO RECOVER THESE FEES WHEN THEY'RE NOT PAID, OR DO YOU HAVE AN ABILITY TO OTHERWISE RESPOND? I'M JUST REFLECTING ON OUR AMENDMENT TO PURSUE DELINQUENT WATER BILLS. SO I'M WONDERING IF WE HAVE THE RIGHT RULES IN PLACE TO PURSUE DELINQUENT FEES? AND TEETH. WE DO. ON THE DEVELOPMENT FEES VERSUS THE UTILITY FEES. WE'RE MUCH MORE PROACTIVE ON THE COLLECTION. WE WON'T GRANT ANY OF THE PERMITS OR LET THEM REALLY MOVE DIRT IN TOWN UNTIL THEY'VE PAID THE FEES. SO COLLECTION DOESN'T TEND TO BE AN ISSUE FOR THOSE TYPES OF REVENUES. I'LL BE HONEST, I LEARNED A LOT READING THE ENTIRE FEE BOOKLET. I'M NOT GOING TO SAY THAT I HAVE BEEN REMISS, MAYBE IN THE PAST DOING WORK I HAVEN'T BEEN, BUT I COULD SEE HOW A LOT OF HOMEOWNERS COULD BE WITH A LOT OF PROJECTS THAT THEY ENDED UP DOING. AND I'M JUST WONDERING, IS THERE SOME KIND OF FORMAL ENFORCEMENT OTHER THAN HOMEOWNERS NOT BEING VERY FAMILIAR WITH THIS? AND IN MANY CASES, THERE'S A LOT OF CONTRACTORS THAT ARE NOT NECESSARILY BEING INVOLVED AND DO A LOT OF THE WORK THAT GETS DONE. I'M JUST A LITTLE WONDERING HOW WE MAKE SURE THAT WE CATCH EVERYTHING WE'RE SUPPOSED TO CATCH. MR. GAUTHIER, YES, YOU'RE EXACTLY CORRECT AND HOMEOWNERS AREN'T GENERALLY GOING TO TELL ON THEMSELVES. RIGHT, HEY, I JUST POURED A PATIO, AND I DIDN'T GET A PERMIT FOR IT. RIGHT. BUT WE DO HAVE A CODE ENFORCEMENT OFFICER THAT IS IN TOWN AT LEAST ONCE A WEEK, AND WE HAVE A BUILDING INSPECTOR THAT'S IN TOWN AT LEAST ONCE A WEEK AS WELL. THEY'RE DRIVING THE NEIGHBORHOODS. THEY'RE ALLOWED INTO ALL THE NEIGHBORHOODS, EVEN THE GATED COMMUNITIES, AND THEY HAVE AN EYE OUT FOR ANY WORK THAT'S BEING DONE THERE. BY LEGALLY, THEY CAN STOP IN AND ASK TO SEE A PERMIT. AND IF THEY DON'T HAVE A PERMIT, THEY CAN SHUT THEM DOWN. IF THEY HAD A RELATIONSHIP, MAYBE WITH THE HOA'S. I THINK THAT, YOU KNOW, THEY ARE TRYING TO DO THINGS RIGHT. YES. AND I'M SURE MOST OF THEM DON'T KNOW THE VASTNESS OF THE SCHEDULE THAT YOU HAVE. IT MIGHT BE GOOD TO HAVE THAT INDIVIDUAL GO AND MEET WITH THE HOA'S, POSSIBLY IN ONE OF THEIR GET TOGETHERS, AND BUILD THAT RELATIONSHIP BECAUSE THAT RELATIONSHIP PREVENTS CONFLICTS. BUT IT WILL ALSO MAKE SURE THAT THEY'LL PROBABLY GIVE A CALL TO OUR INDIVIDUAL AND LET THEM KNOW, HEY, THERE'S SOMETHING YOU NEED TO LOOK AT. YOU DO NEED TO PAY A FEE OR NOT. RIGHT. AWARENESS IS IMPORTANT. ABSOLUTELY. I KNOW WE HAVE ON OUR FUTURE. BUT I WILL SAY JUST SIX MONTHS OR SO, WE KNOW THEY'VE DONE A PRETTY GOOD JOB CATCHING SOME THINGS. SO I KNOW IT'S WORKING. ANY OTHER QUESTIONS? CAN I GET A MOTION TO APPROVE ORDINANCE 1012? SO MOVED. I GET A SECOND. SECOND. ALL IN FAVOR? AYE, AYE. ANY OPPOSED? MOTION CARRIES. THROW ME OFF WITH A DELAYED MOTIONS AND SECOND. SO WE NEED CAFFEINE. ALL RIGHT CASEY, THE NEXT ONE. [H.6. Discuss, consider and act to adopt Ordinance 1014, Amending the Water and Sewer Rates (Cayce Lay Lamas, Finance Director)] YOU'RE UP. ORDINANCE 1014. DISCUSS. CONSIDER AN ACT TO ADOPT ORDINANCE 1014, AMENDING THE WATER AND SEWER RATES. ALL RIGHT, SO THIS IS JUST THAT SEPARATE ORDINANCE THAT I MENTIONED. WE'RE CHANGING VERY LITTLE HERE AS WELL. THE FEW THINGS THAT I DID WANT TO SPECIFICALLY MENTION, WE ARE NOT CHANGING ANY OF OUR USAGE OR BILLING FEES. SO ANYBODY THAT IS AN EXISTING CUSTOMER, THERE WILL BE NO CHANGES TO YOUR BILL. HOW WE CHARGE YOU WITH THIS ADOPTION. AND THE ONLY THINGS THAT WE ACTUALLY CHANGED WHENEVER WE WERE REVIEWING ALL OF OUR FEES, WE REALIZED THAT ARE COMMERCIAL AND RESIDENTIAL DEPOSITS FOR SEWER WEREN'T THE SAME, SO WE CORRECTED THAT. AND THEN THE OTHER ITEM THAT WE UPDATED ARE SOMETHING CALLED MINIMUM SERVICE TAP FEES. AND THIS IS A VERY RARE REVENUE SOURCE FOR US. THIS IS WHAT WE WOULD BE CHARGING IF OUR PUBLIC WORKS STAFF WERE HIRED BY A DEVELOPER TO GO OUT AND SET THOSE DIFFERENT WATER OR SEWER METERS. USUALLY THE CONTRACTOR HAS SOMEBODY OR THE DEVELOPER HAS A CONTRACTOR THAT DOES THAT FOR THEM, BUT WE JUST WANT TO MAKE SURE THAT WE'RE APPROPRIATELY ACCOUNTING FOR THE TIME AND RESOURCES IT TAKES TO DO THAT WORK IF WE ARE ASKED. I THINK THE ONE THING I WOULD NOTE WE WERE IT WASN'T TOO MANY MEETINGS AGO. WE WERE HAVING A DISCUSSION AROUND TAP IMPACT FEES. [00:55:02] AND AND AT THAT POINT WE SAID WE DON'T COLLECT ANY. BUT IN FACT AND WE TALKED ABOUT IT THEN FORT WORTH DOES COLLECT IMPACT FEES WHEN WE DO A WATER TAP. SO WHEN WE DO BRING THAT DISCUSSION BACK AND THERE'S A RECOMMENDATION COMING FOR HOW MUCH SHOULD WESTLAKE ASSESS AS AN IMPACT FEE? I JUST JUST HOPE THAT WE CAN REFERENCE THE FORT WORTH IMPACT FEE THAT'S ALREADY BEING COLLECTED. IT'S NOT IT'S NOT INSIGNIFICANT. DEPENDING ON THE SIZE OF THE WATER METER THAT YOU'RE PUTTING IN. SO WE DIDN'T HAVE THAT DISCUSSION AND INFORMATION AVAILABLE TO US WHEN WE'RE TALKING ABOUT WESTLAKE IMPACT FEES. SO LET'S PLEASE INCORPORATE WHAT WE SEE IN THIS FEE SCHEDULE WHEN WE HAVE THAT DISCUSSION NEXT TIME. ABSOLUTELY. OKAY. ANY OTHER QUESTIONS? CAN I GET A MOTION TO APPROVE ORDINANCE 1014? SO MOVED. SECOND. THERE YOU GO. THANK YOU. SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? MOTION CARRIES. THANK YOU ALL VERY MUCH. [H.7. Discuss, consider and act to excuse Mayor and Council absence(s), if any.] AGENDA ITEM 8724368. DO WE HAVE ANY EXCUSES FOR MERRITT COUNCIL ABSENCES? WELL, I JUST WANT TO MENTION, MAYOR, THAT I'M HAVING BACK SURGERY TOMORROW, AND I'M ASSUMING THAT I'M GOING TO BE HEALTHY ENOUGH TO ATTEND THE MEETING ON DECEMBER 9TH. I MIGHT HAVE TO DO IT BY VIDEO. THAT'S FINE. AND WE WISH YOU GOOD LUCK WITH YOUR SURGERY. [I. EXECUTIVE SESSION] THE TIME IS NOW 4:56. VERTICAL BRIDGE VERSUS TOWN OF WESTLAKE. THE REGULAR MEETING WILL NOW ADJOURN. IT'S 4:57. [J. TAKE ANY ACTION, IF NEEDED, FROM EXECUTIVE SESSION ITEMS] TO RECONVENE. REGULAR SESSION. IT'S 5:50 P.M.. AGENDA ITEM J. TAKE ANY ACTION NEEDED FROM EXECUTIVE SESSION, WHICH I DON'T THINK WE HAVE ANYTHING. NO, SIR. OKAY. FUTURE AGENDA ITEMS. ANYTHING WE NEED TO TALK ABOUT FOR YOU GUYS? IF Y'ALL HAVE A FUTURE AGENDA ITEM THAT YOU'D LIKE TO PUT ON THE LIST. NOT FOR ME. I THINK WE'VE COVERED EVERYTHING. [L. STAFF RECAP OF COUNCIL DIRECTION] WADE, STAFF RECAP AND COUNCIL DIRECTION. YES, SIR. SO, QUICK STAFF RECAP. WE'RE GOING TO BE TABLING 24-78 AND 24-75 TO, THAT'S THE DCAD AND THE AND THE TCAD, BOTH THEIR ELECTIONS. WE'RE GOING TO TABLE THOSE TO DECEMBER 9TH. I'M GOING TO COORDINATE A MEETING BETWEEN THE HOAS AND OUR CODE ENFORCEMENT AND INSPECTORS. AND THEN WHEN WE GET TO OUR IMPACT FEE DISCUSSION, WE'RE GOING TO MAKE SURE THAT WE'RE TALKING ABOUT BOTH THE IMPACT FEES THAT ARE PASSED THROUGH FROM THE TOWN OF OUR CITY OF FORT WORTH AND THE ONES THAT ARE GENERATED FROM HERE IN WESTLAKE. AND THE PURPOSE OF BOTH. OKAY. AND, WADE, WOULD YOU PLEASE. AND I KNOW YOU WILL MAKE SURE ON THIS LEAD REMEDIATION WITH A COUPLE OF HOMEOWNERS, YOU JUST KIND OF KEEP US UP TO DATE ON WHAT'S GOING ON THAT I COULD. YES, SIR. AND THEN, LIKE I SAID, ON DECEMBER 9TH, WE'LL TRY TO BRING FORWARD A PROGRAM THAT CAN HELP THOSE FOLKS OUT. OKAY, GREAT. THANK YOU. THE NEXT REGULAR TOWN COUNCIL BOARD OF TRUSTEES MEETING WILL BE HELD MONDAY, DECEMBER 9TH. EVERYBODY HAVE A GREAT THANKSGIVING. TREE LIGHTING IS DECEMBER 4TH. PLEASE, EVERYBODY MAKE IT IF YOU CAN. THANK YOU. * This transcript was compiled from uncorrected Closed Captioning.
