GOOD EVENING, AND WELCOME TO THE WESTLAKE TOWN COUNCIL BOARD OF TRUSTEES MEETING FOR JANUARY [A. CALL REGULAR MEETING TO ORDER AND ANNOUNCE A QUORUM PRESENT] [00:00:10] 6TH, 2025. I CALL THE MEETING TO ORDER. THE TIME IS 4:00 PM. A QUORUM IS PRESENT. COUNCILMAN ASSELTA IS IN THE LOVELY PACIFIC NORTHWEST AT A BUSINESS MEETING. I'D LIKE TO START WITH THE PLEDGE OR THE PRAYER, PASTOR FRANKLIN, THANKS FOR BEING HERE. LET'S PRAY. JESUS, WE THANK YOU FOR THIS DAY. WE THANK YOU FOR THE CITY OF WESTLAKE AND THESE COUNCIL MEMBERS AND OUR AMAZING MAYOR. AND WE PRAY YOU BLESS THEM ALL, ENCOUNTER THEM, GIVE THEM WISDOM AND STRATEGIES AND STRATEGIES FOR CHANGE OF THINGS THAT NEEDS TO CHANGE, AND WISDOM FOR HOW TO HANDLE THE GROWTH. IN JESUS NAME, BLESS THIS CITY. AMEN. AMEN. THANK YOU FOR BEING HERE. NOW PLEASE ALL RISE FOR THE PLEDGE OF ALLEGIANCE AND THE PLEDGE. HI, EVERYBODY. TONIGHT WE HAVE CAROLINE AND CONNOR JASTAK AND THEY'RE HERE FROM THE ACADEMY. CAROLINE'S AN EIGHTH GRADER, AND CONNOR IS A SIXTH GRADER. AND THEIR TEACHERS DESCRIBE THEM BOTH AS BEING EXTREMELY COMMUNICATIVE, COMMUNICATIVE. I'LL TRY THAT AGAIN. AND KIND AND JUST GREAT EXAMPLES OF WESTLAKE ACADEMY STUDENTS. SO WE'RE VERY HONORED TO HAVE THEM HERE TO LEAD OUR PLEDGES, I TOOK I GATHERED THAT. THANK YOU ALL SO MUCH. LET'S GET A QUICK PICTURE. AND I THINK KEVIN'S A WRITER FOR OUR WESTLAKE PUBLICATION THAT COMES OUT. THANK YOU. OKAY. [C. CITIZEN/PARENT COMMENTS] CITIZENS PARENT COMMENTS I HAVE MR. THORNTON. WELL, LET'S GET TO IT. HOW ARE YOU? I'M FINE, THANK YOU VERY MUCH. I APPRECIATE THIS TIME AND THIS OPPORTUNITY. MAYOR. TOWN COUNCIL. MY NAME IS STEVEN THORNTON. I MY MAILING ADDRESS IS 13187 THORNTON DRIVE. WESTLAKE. AND I'M HERE TO REPRESENT A NONPROFIT CALLED INSPIRARE PRODUCTIONS. IT'S HOME BASED IN THIS AREA, SO I'D LIKE TO BRING IT TO YOUR ATTENTION. THIS IS LAURA. SHE'S GOING TO PASS OUT OUR BROCHURES. THESE ARE MEMBERS. SHE'S ONE OF OUR MEMBERS. SHE IS MEMBER NASH. AND THE IDEA IS WE GET PEOPLE TOGETHER TO CREATE MEANINGFUL EXPERIENCES. SO WE'RE NOT QUITE EXACTLY ABOUT JUST ENTERTAINMENT. WE LIKE TO BRING A LITTLE BIT MORE TO THAT OCCASION WHEN POSSIBLE. SO I'LL REPEAT THAT AGAIN. WE CREATE EVENTS FOR MEANINGFUL. WE, I'M SORRY. WE CREATE EVENTS FOR MEANINGFUL OCCASIONS. SO, A LITTLE OVER A MONTH AGO, WE GATHERED AROUND A TREE. IT WAS THE LARGEST CLASSIC CHRISTMAS TREE IN NORTH TEXAS RIGHT HERE IN WESTLAKE. IF YOU STEP ON YOUR TOES, YOU MIGHT BE ABLE TO SEE IT FROM HERE. BUT IT'S A IT'S SOMETHING THAT WAS MEANINGFUL AT THE TIME. WE HAD A COUPLE OF CELLISTS, WE SANG SONGS AND WE GOT THE COMMUNITY TOGETHER. THE LOCAL COMMUNITY. ANOTHER THING WE DID WAS ON AN ANNUAL BASIS, WE GET PEOPLE TOGETHER AT AN 1870S COTTAGE. ANOTHER INTERESTING ITEM IN WESTLAKE. THE COTTAGE WAS BUILT BASICALLY FOR THE USE OF A STAGECOACH STOP. WE ACTUALLY HAD SOMEONE LAST YEAR COME IN ON HORSEBACK. HE WAS REENACTING THE PERSON WHO BUILT THAT, HENRY KELLER. NOT RELATED TO THE CITY OF KELLER, BUT HE BUILT THE BUILDING OUT OF ROCK WITH HIS SON AND LATER CAME BACK AND PURCHASED THE PROPERTY AFTER BEING COMMISSIONED TO [00:05:06] BUILD IT. THESE BOOKS ARE HISTORICAL BOOKS ABOUT WESTLAKE. IN CASE YOU HAVEN'T SEEN ONE, THESE BOOKS ARE ABOUT WESTLAKE. WE LIKE TO BRING PEOPLE TOGETHER, TO CONNECT THEM TO OUR HISTORY, TO, ONE OF THE THINGS WE DO IS TO CONNECT PEOPLE TOGETHER. THIS YEAR WE'D LIKE TO HAVE A PARTNERSHIP WITH THE TOWN OF WESTLAKE FOR A MARKER DEDICATION. I THINK IT'S TIME THAT WE, WE'VE GOT ENOUGH INFORMATION TO DO THAT. I'VE BEEN POSTPONING THIS FOR SOME, SOME YEARS. THE LAST TIME I PURCHASED A HISTORICAL MARKER, IT WAS QUITE A FEW YEARS AGO. IT WAS FOR $1,800, OR PROBABLY TWICE THAT NOW. BUT I'D LIKE TO BRING THAT TO YOUR ATTENTION NOW, BECAUSE IN SEPTEMBER WE'RE HOPING TO HAVE ANOTHER FRONTIER DAY WHERE WE HAVE PEOPLE COME TOGETHER, AND THIS SHOULD BE EVEN THE BEST MARKER DEDICATION, BECAUSE WE HAVE TIME TO PUT ALL OF THIS TOGETHER. WE CREATE THE FUN, THE FOOD, THE MUSIC. WE HAVE THE OCCASION TO BRING ALL OF THIS TO THE SITE. NORMALLY WHEN WE'VE HAD A DEDICATION AND I'VE PUT TOGETHER EIGHT OF THEM SO FAR, WE WOULD HAVE TO COME THERE, HAVE THE OCCASION AND LEAVE. WELL, THIS TIME WE'RE GOING TO MAKE IT RIGHT. WE ACTUALLY FOUND OUT OVER THE YEARS THAT IF WE HAD FOOD AND A LITTLE BIT OF WINE AND JUST SOME FUN AND COMFORT, WE HAD SOME TIME TO TALK. WE HAD AT LEAST TWICE AS MANY COME BY TO SEE THAT. I WOULD LIKE TO ALSO REQUEST, PERHAPS ON MY PERSONAL BASIS $800 FOR THE ROAD. BASE FOR PEOPLE TO PULL OFF OF A VERY BUSY ROAD. ROANOKE ROAD IT'S ENOUGH TO GET PEOPLE OFF SAFELY AND GET THEM BACK ON SAFELY. TO READ THE MARKER. SO THAT'S THE TWO REQUESTS THAT INSPIRARE PRODUCTIONS WOULD LIKE TO MAKE, AND WE BELIEVE THAT THIS WOULD BE SOMETHING SIGNIFICANT FOR THE COMMUNITY. THIS IS SOMETHING THAT WOULD GO ON FOR QUITE SOME TIME AND MEANINGFUL WAYS. SO IT WAS GOOD TO SEE YOU. I KNOW I'VE GOT THREE MINUTES. I THINK MY TIME IS UP. SO I WANTED TO BRING THAT TO YOUR ATTENTION. I APPRECIATE THE WORK THAT YOU'RE DOING FOR THE COMMUNITY. THANK YOU. THANK YOU, MR. THORNTON. THANK YOU FOR THE BOOKS. THESE ARE GREAT. I LOVE THE HISTORY. ITEMS OF COMMUNITY INTEREST, MR. [D.1. Items of Community Interest (Communications Director Jon Sasser)] SASSER. GOOD EVENING, MAYOR. COUNCIL. GOOD EVENING EVERYBODY. WE'VE GOT QUITE A FEW THINGS GOING HERE, SO LET'S START OFF WITH THE PLANNING AND ZONING MEETING THAT WAS SCHEDULED FOR TOMORROW HAS BEEN CANCELED. SO WE WON'T BE HAVING THAT TOMORROW. OUR TOWN HALL, MUNICIPAL COURT, WILL BE CLOSED ON MONDAY, JANUARY 20TH TO CELEBRATE AND TO OBSERVE THE MLK HOLIDAY. OUR NEXT TOWN COUNCIL MEETING IS GOING TO BE TUESDAY, JANUARY 21ST. USUALLY THEIR ON A MONDAY, BUT BECAUSE OF THE MLK HOLIDAY, IT'S GOING TO BE ON TUESDAY. AGAIN, IT'S ON JANUARY 21ST. WANT TO BRING TO YOUR ATTENTION THE SOME ELECTION FILING DATES? THE FILING PERIOD FOR THE MAY 3RD ELECTION, GENERAL AND SPECIAL ELECTION IS JANUARY 15TH THROUGH FEBRUARY 14TH. OUR GENERAL ELECTION FOR COUNCIL MEMBERS PLACES ONE, THREE AND FIVE WITH TERMS FROM MAY 2025 THROUGH MAY 2027, AS WELL AS OUR SPECIAL ELECTION FOR COUNCIL MEMBER TWO UNEXPIRED TERM THROUGH MAY 2026. I ALSO WANT TO BRING UP AN EXCITING EVENT THAT'S COMING UP FOR SOME SELECT STUDENTS AT WESTLAKE ACADEMY, THE INTERNATIONAL STUDENT LEADERSHIP SYMPOSIUM 2025. THAT'S FROM JANUARY 13TH TO THE 21ST. THIS IS REALLY COOL. IT'S SOMETHING THAT THE STUDENTS HAVE BEEN DOING AT THE ACADEMY FOR SEVERAL YEARS NOW, AND IT'S A SELECT FEW STUDENTS WHO ARE TRAVELING TO ANOTHER IB SCHOOL THIS YEAR IN THAILAND. IT'S A HIGHLY SELECTIVE APPLICATION PROCESS WITH SEVERAL ROUNDS OF CUTS. AND EACH YEAR THEY TACKLE ONE LARGE PROBLEM FACING THE GLOBE. THIS YEAR, THEY'RE TALKING ABOUT DISCUSSING SUSTAINABILITY AS IT PERTAINS TO PROTECTING TREES, FORESTS, TERRESTRIAL ECOSYSTEMS AND KEEPING THE PLANET LUSH AND VIABLE FOR FARMING. IT'S A REALLY BIG DEAL. HONESTLY, IT'S REALLY COOL. THE STUDENTS AND TEACHERS WILL BE STAYING WITH HOST FAMILIES AND WILL SPLIT TIME BETWEEN THE ACTUAL SYMPOSIUM AND EXPLORING THE REGION. AS A MATTER OF FACT, OUR COMMUNICATIONS MANAGER, JOE DURDEN, IS GOING TO BE SITTING DOWN WITH THOSE WITH THOSE STUDENTS HERE IN THE NEXT COUPLE OF DAYS TO KIND OF GIVE A PREVIEW OF WHAT TO EXPECT THE SELECTION PROCESS, BECAUSE IT'S QUITE VAST AND I'M VERY COMPETITIVE AND ALSO TALK TO THEM ABOUT WHAT THEY'RE EXCITED ABOUT AND WHAT THEY'RE HOPING TO LEARN ON THEIR TRIP. SO STAY TUNED FOR THAT. AND THEN WE HAVE STUDENTS IN THAT FOR SURE. YES. WESTLAKE ACADEMY. YES, SIR. YEAH WE DO. AND JUST SORRY, I DON'T WANT TO JUMP IN. JUST SO YOU GUYS KNOW IF THIS WILL BE A GREAT, FUN TRIP. [00:10:01] IT'S 38 HOURS OF TRAVEL TO GET THERE AND THEN ANOTHER 38 TO GET BACK. SO THESE KIDS IN THE CHAPERONS ARE THERE. THEY'RE IN FOR AN AMAZING TRIP, BUT IT'S A LOT. THEY KNOW WHAT THEY'RE IN FOR SURE. SO IT SPEAKS TO THEIR DEDICATION THAT THEY'RE WILLING TO TRAVEL FOR 76 HOURS AND STILL BE A PART OF THIS. AND THEN FINALLY WANT TO OBVIOUSLY BRING UP I KNOW EVERYBODY'S GOT THEIR EYE ON THE WEATHER. WE'RE WE JUST TALKED TO THE NATIONAL WEATHER SERVICE JUST A COUPLE OF HOURS AGO. THEY'RE TELLING US THEY'RE EXPECTING ANYWHERE FROM 1 TO 4IN OF SNOW OVERNIGHT WEDNESDAY INTO THURSDAY MORNING. ICE AND SLEET AS WELL. EXPECTED TO REFREEZE WITH THE TEMPERATURES BELOW 32 THURSDAY NIGHT INTO FRIDAY. SO THURSDAY AND FRIDAY COULD BE A LITTLE ADVENTUROUS FOR ALL OF NORTH TEXAS, BUT SPECIFIC TO US HERE WITH THE ACADEMY AND THE TOWN AS WELL. WE WILL MEET AS A STAFF TOMORROW MORNING AT 11 A.M. TO DISCUSS WITH CHIEF ARD, AND THEN, OF COURSE, WE'LL HAVE A ANOTHER CONFERENCE CALL WITH THE NATIONAL WEATHER SERVICE TOMORROW AT 1:00 SHORTLY AFTER THAT TO GET FURTHER UPDATES. OUR COMMUNICATIONS SPECIALIST, ALEXA, HAS CREATED A WEB PAGE ON OUR WEBSITE. IT'S ACTIVE NOW. IT'S COMPREHENSIVE WITH ALL KINDS OF GREAT INFORMATION ON THERE. SO I URGE YOU GUYS TO CHECK THAT OUT. AND OF COURSE, WE ALREADY STARTED OUR COMMUNICATIONS BACK ON FRIDAY, AND I BELIEVE THEY SENT SOMETHING OUT TODAY WITH THE ACADEMY. THAT WAS GOOD, GIVING EVERYBODY A HEADS UP OF WHAT TO EXPECT. BUT WE'RE GOING TO KEEP OUR EYE ON IT AND KEEP EVERYBODY VERY MUCH INFORMED AS WE GO IN THE NEXT 48 HOURS. WINTER'S HERE. YES, SIR. AT LEAST FOR A WEEK. YEAH. THOSE ARE YOUR ITEMS OF COMMUNITY INTEREST. THANKS, JOHN. AGENDA ITEM EIGHT. [E. CONSENT AGENDA] CONSENT AGENDA. CAN I GET A MOTION TO PASS THE CONSENT AGENDA? SO MOVED. SECOND. SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? MOTION CARRIES. ITEM AGENDA ITEM F PUBLIC HEARINGS AND CORRESPONDING ACTION ITEMS. [F.1. Hold a public hearing, receive and discuss the 2024 Charter FIRST rating for Westlake Academy based on School Year 2022-2023 data, and the Annual Financial Management Report (Marlene Rutledge, Academic Finance Manager)] WA24-52. HOLD A PUBLIC HEARING. RECEIVE AND DISCUSS THE 2024 CHARTER. FIRST RATING FOR WESTLAKE ACADEMY BASED ON SCHOOL YEAR 2022-23 DATA AND THE ANNUAL FINANCIAL MANAGEMENT REPORT. MARLENE AND CASEY. GOOD AFTERNOON. ALL RIGHT, SO THE POINT OF TODAY'S PUBLIC HEARING IS TO MEET SOME STATUTORY REQUIREMENTS OUTLINED BY THE EDUCATION CODE AND REQUIRED BY TEA. SPECIFICALLY, YOU'LL NOTICE THAT WE HAVE A PUBLIC HEARING TODAY THAT DOESN'T REQUIRE ANY ACTION ON THE PART OF COUNCIL. THIS IS JUST AN INFORMATIONAL PRESENTATION. WE'LL OPEN THE PUBLIC HEARING AND THEN WE'LL CLOSE IT. AND SO FOR EVERYONE'S EDIFICATION. THE CHARTER FIRST RATING IS A FINANCIAL ACCOUNTABILITY RATING. IT'S REQUIRED BY THE TEXAS EDUCATION AGENCY, BASICALLY AS A TRANSPARENT WAY TO SAY, HERE'S HOW WE'RE DOING OVERALL, ACCORDING TO SOME VERY SPECIFIC CRITERIA, ALL CHARTER SCHOOLS THAT ARE PUBLIC THROUGHOUT THE STATE USE THIS SAME CRITERIA. IT'S VERY SIMILAR TO ONES THAT ARE USED FOR THE FIRST RATING, WHICH IS SPECIFIC TO ISD'S. IT'S GOT 21 VERY, VERY SPECIFIC CRITERIA, FIVE OF WHICH ARE CONSIDERED CRITICAL FACTORS. A FAIL ON ANY ONE OF THOSE AUTOMATICALLY FAILS THE ENTIRE THING. AND SO WHAT HAPPENED FOR US THIS YEAR WAS WE HAD AN ERP OR A SOFTWARE CONVERSION. WE HAD A TON OF DELAYS WITH THE DATA CONVERSION PROCESS OF THAT, WHICH DELAYED BEING ABLE TO PROVIDE INFORMATION TO OUR AUDITORS, WHICH IN TURN DELAYED THE DELIVERY OF THE AUDIT. SO INSTEAD OF US DELIVERING THE AUDIT WITHIN THE STATUTORILY REQUIRED 150 DAYS, IT WAS MUCH LATER COUNCIL DID APPROVE THAT IN NOVEMBER. IN AUGUST OF 24. SO SEVERAL MONTHS AFTER IT WAS DUE. BECAUSE OF THAT, IT'S A CRITICAL FACTOR. IT DID CAUSE US TO AUTOMATICALLY FAIL THIS. WITH THAT BEING SAID, WE HAVE ALREADY CAUGHT UP. THIS BOARD HAS ALREADY APPROVED THE 24 AUDIT. GETTING US BACK ON SCHEDULE AND MAKING SURE THAT WE DON'T HAVE THIS HAPPEN AGAIN. THIS IS THE FIRST TIME IN THE HISTORY OF OUR ACADEMY THAT WE'VE NOT PASSED OUR CHARTER FIRST RATING. WHAT ARE THE IMPLICATIONS FOR THIS SUBSTANDARD REPORT? SO TO LOOK SPECIFICALLY OVER A PERIOD OF FIVE YEARS, AND WHENEVER YOU START HAVING FAILS THREE OUT OF THOSE FIVE YEARS, THEN THEY MIGHT INTERVENE AND START COMING OVER AND SAYING, HEY, WE WOULD LIKE TO TAKE MORE ACTUAL ACTION WITH YOUR BOOKS. BUT AGAIN, WE DON'T EXPECT THAT TO HAPPEN. WE'RE ALREADY BACK ON TRACK FOR SCHOOL YEAR 24. THE ONE THING I WOULD ASK AND LOOK, I KNOW THERE'S BEEN A LOT OF TRANSITION AND STABILITY. NOW, WERE WE GIVEN A HEADS UP THAT WE WERE LATE ON THIS REPORT? DID WE KNOW IT THROUGH THE PROCESS? AND WE DID. OKAY. AND IT WILL NEVER HAPPEN AGAIN. CORRECT. CORRECT. AS I SAID, WE'VE ALREADY REMEDIED IT GOING FORWARD. RIGHT. I KNOW IT WON'T. ALL RIGHT. AND THEN THE SCORE SHEET THAT WE FILLED OUT WITH ALL OF THE DATA ON ALL 21 OF THESE CRITERIA ARE INCLUDED IN THE PACKET. IT'S LENGTHY. I'M NOT GOING TO GO INTO IT BECAUSE CRITERIA NUMBER ONE WAS DID YOU SUBMIT THE AUDIT ON TIME. [00:15:05] AND THEN AFTER THAT T DOESN'T LOOK AT ANYTHING ELSE. THAT ONE KIND OF STUCK OUT. YEAH. ALL RIGHT. AND SO WHENEVER WE'RE TALKING ABOUT THE IMPACT AS I SAID, IT'S ONLY REALLY AN ISSUE IF WE HAVE CONTINUED FAILS THREE OUT OF FIVE YEARS. THE FIVE YEARS PRIOR WE DON'T EXPECT THAT TO CONTINUE. AND THE THINGS THAT COULD END UP HAPPENING IF WE HAD CONTINUED SHORTCOMINGS COULD GO AS FAR AS A REVOCATION OF THE CHARTER. AGAIN, NOT GOING TO HAPPEN. WE'VE ALREADY REMEDIED THAT. ALL RIGHT. AND THEN THE OTHER FUN LITTLE THING. SO OUTSIDE OF THOSE 21 CRITERIA THAT WE'RE REQUIRED TO REPORT ON AND ACTUALLY COMPLETE A SCORECARD ON, WE HAVE FIVE VERY SPECIFIC DISCLOSURES THAT ARE REQUIRED. WE DO MAKE SURE TO LINK THE HEAD OF SCHOOL CONTRACT ON OUR WEBSITE. THAT'S A REQUIREMENT. ACCORDING TO THIS WE ALSO HAVE ANY TYPES OF GIFTS, ANY TYPES OF REIMBURSEMENTS. WE HAVE TO DISCLOSE ALL OF THOSE TO TEA. WE DIDN'T HAVE ANYTHING WEIRD OR CRAZY OR HIGH FOR SCHOOL YEAR 23, JUST THE NORMAL CONTRACT AND A COUPLE OF NORMAL TRAVEL REIMBURSEMENTS. AND WITH THAT, ARE THERE ANY QUESTIONS ON THE CHARTER? FIRST, I HAVE A COMMENT. CASEY, I READ THROUGH THE REPORT AND I SEE THAT ALL THE THINGS THAT WE WERE SHORT ON, YOU'VE ADDRESSED AND YOU'VE ADDRESSED VERY CLEARLY. SO YOU MADE IT BE COMFORTABLE THAT YOU WHAT YOU'RE SAYING IS WHAT IS ACTUALLY GOING TO HAPPEN. EXCELLENT. THANK YOU SIR. THEN CASEY AND I NEED TO MENTION WADE IS A WAY. HE'S ON HIS 30TH ANNIVERSARY. SO JASON IS SITTING IN FOR WADE. THANK YOU JASON. DO WE FEEL COMFORTABLE THAT WE HAVE A GOOD MASTER CALENDAR NOW? WE'VE BEEN HERE ALMOST TWO YEARS. DO WE HAVE A MASTER CALENDAR OF ALL THESE KEY EVENTS, NOT ONLY FOR FINANCE, BUT FOR THE TOWN THAT WE HAVE IN OUR METRICS, AND WE KNOW WHEN THINGS AREN'T GOING WELL? YES, SIR. IN FACT, IF ANYBODY WOULD CARE TO COME SEE MY CRAZY CALENDAR, IT'S NICE AND COLOR COORDINATED AND I'VE GOT A HARD COPY ON MY WALL. I LIVE FOR THAT. I PUSH IT OUT TO EVERYBODY AND OKAY. I JUST WANT TO MAKE SURE AS WE KIND OF GET IN OUR, YOU KNOW, OPERATING CADENCES AND STUFF WITH WHAT WE HAVE, I WANT TO MAKE SURE THIS STUFF DOESN'T HAPPEN AGAIN. AGREED. WE KNOW IT WON'T. OKAY. I NEED TO OPEN UP FOR A PUBLIC HEARING. IS THERE ANYONE THAT WISHES TO SPEAK OR COMMENT? OPEN UP THE PUBLIC HEARING. I'LL TAKE THAT AS A NO. WE'LL CLOSE THE PUBLIC HEARING. CASEY. THANK YOU. THANK YOU ALL. NOW, HOLD ORDINANCE 1015, HOLD A PUBLIC HEARING. [F.2. Hold a public hearing, discuss, consider and act to adopt Ordinance 1015 approving text amendments to PD, Planned Development District No. 3-8 generally located at the southeast corner of U.S. Highway 377 and State Highway 170; providing a penalty; providing a cumulative clause; providing a severability clause; providing a savings clause; and establishing an effective date.] DISCUSS, CONSIDER, AND ACT TO ADOPT ORDINANCE 1015. APPROVING TEXT AMENDMENTS TO PD PLANNED DEVELOPMENT DISTRICT NUMBER 3-8. GENERALLY LOCATED AT THE SOUTHEAST CORNER OF U.S. HIGHWAY 377 AND STATE HIGHWAY 170. PROVIDING A PENALTY. PROVIDING A CUMULATIVE CLAUSE. PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, AND ESTABLISHING AN EFFECTIVE DATE. MR. ALEXANDER, THANK YOU, HONORABLE MAYOR, TOWN COUNCIL. GOOD AFTERNOON. THE ITEM IN FRONT OF YOU IS A REQUEST FOR SEVERAL TEXT AMENDMENTS TO PD THREE EIGHT, AND JUST SOME HISTORY TO START OFF WITH FOR PD THREE EIGHT. ON SEPTEMBER 14TH, 1998, TOWN COUNCIL APPROVED ORDINANCE NUMBER 307. AND THAT ESTABLISHED THE RULES AND REGULATIONS FOR A PD PLANNED DEVELOPMENT DISTRICT FOR THE ENTIRETY OF THE CIRCLE T RANCH. THAT SAME DAY, THE TOWN COUNCIL ALSO APPROVED BY ORDINANCE NUMBER THREE, 14 SPECIFIC AND DISTINCT SETS OF RULES AND REGULATIONS FOR PD PLANNED DEVELOPMENT DISTRICT THREE EIGHT OR PD THREE EIGHT. AND THAT IS TO CONSIST PRIMARILY OF RETAIL, OFFICE, AND HEAVY COMMERCIAL USES. A COUPLE OF PHOTOS OF THE SITE. AND IN TERMS OF THE REQUEST, THE TEXT AMENDMENTS WILL GO THROUGH THOSE IN GREATER DETAIL IN THE FOLLOWING SLIDES. THEY DO NOT APPEAR TO MATERIALLY IMPACT THE DEVELOPMENT PLAN. HENCE, THE DEVELOPMENT PLAN HAS NOT BEEN BROUGHT FORWARD THIS EVENING TO THE TOWN COUNCIL. THE SECOND THING IS THAT THE TEXT AMENDMENTS, THEY ARE INTENDED TO INTRODUCE MORE CONTEMPORARY RULES AND REGULATIONS TO FACILITATE DEVELOPMENT AND GROWTH ALONG US HIGHWAY 377. THOSE TEXT AMENDMENT APPLICATIONS WILL HAVE IMPACTS ON THE ECONOMIC AND PHYSICAL DEVELOPMENT IN THIS AREA. AND SUFFICE IT TO SAY THAT THE PD FOR THIS PROPERTY, IT IS ALMOST 26, 27 YEARS OLD. IN TERMS OF SOME OF THOSE KEY CHANGES, THE FIRST ONE IS INTRODUCING A DEFINITION FOR LOT COVERAGE THAT IS A MORE CONTEMPORARY URBAN PLANNING TERM, WHICH [00:20:03] ELIMINATES THE FLOOR TO AREA RATIO AND WITHIN THE OFFICE RETAIL SUB AREAS, THAT WOULD BE A MAXIMUM LOT COVERAGE OF 80% WITHIN OFFICE INDUSTRIAL. THE MAXIMUM LOT COVERAGE WOULD BE 70%. THAT LOT COVERAGE DEFINITION WOULD INCLUDE PARKING AREAS AND OTHER IMPERMEABLE SURFACES OUTSIDE OF ROOF STRUCTURES AND BUILDINGS. THERE ARE SOME SPECIFIC USES THAT HAVE ESTHETIC STANDARDS THAT HAVE BEEN SLIGHTLY RELAXED DUE TO THE NATURE OF THEIR OPERATIONS, AND THERE ARE SOME CONSIDERATIONS FOR BUILDING HEIGHT AND FOR LANDSCAPING STANDARDS THAT HAVE BEEN UPDATED AS WELL. SO IN SUM, THE PROPOSED TEXT AMENDMENTS ARE GENERALLY CONSISTENT WITH THE ESTABLISHED LAND USE AND DEVELOPMENT PATTERNS ALONG THE US HIGHWAY 377 CORRIDOR. THIS ITEM WAS INITIALLY ADVERTISED AS A PUBLIC HEARING, AS THERE WAS A CONTEMPLATION THAT SOME OF THE BOUNDARIES OF SOME OF THE SUBDISTRICTS COULD CHANGE. THOSE SUBDISTRICT BOUNDARIES ARE NOT CHANGING AT THIS TIME, AND THE PLANNING AND DEVELOPMENT DEPARTMENT DOES RECOMMEND APPROVAL OF THE TEXT AS FOLLOWS. THAT AN ADDITIONAL NOTE BE ADDED TO THE PERMITTED USE TABLE TO READ AS FOLLOWS. AFTER SITE PLANS HAVE BEEN SUBMITTED FOR THE FIRST DATA CENTER AND THE OFFICE INDUSTRIAL SUBDISTRICT FOR REVIEW AND APPROVAL. EACH SUCCESSIVE DATA CENTER THEREAFTER SHALL REQUIRE AN SGP. THIS RESTRICTION SHALL ONLY APPLY TO THE OFFICE INDUSTRIAL SUBDISTRICT AND TO PROVIDE SOME CLARIFICATION ON THAT. THAT IS, CONTEMPLATING THAT IF THE BOUNDARIES OF THE OFFICE INDUSTRIAL SUBDISTRICT SHOULD CHANGE AND THERE'S A DESIRE FOR ANOTHER DATA CENTER TO COME INTO THE WESTLAKE MARKET, THAT THERE WILL BE TIME ON THE TOWN'S PART TO BE ABLE TO CONSIDER INFRASTRUCTURE AND OTHER NEEDS TO ACCOMMODATE THAT TYPE OF DEVELOPMENT. HENCE THE REQUIREMENT, AS PROPOSED FOR AN SGP, THAT THE DESIGN AND CONSTRUCTION OF THE FIRST DATA CENTER AND THE OFFICE INDUSTRIAL SUBDISTRICT, ONLY THAT THE EXTERIOR FINISH, MATERIAL REQUIREMENTS AND OTHER ARCHITECTURAL FEATURES CONTAINED IN THE BUILDING QUALITY MANUAL ONLY APPLY TO THE BUILDING FACADES FACING UNITED STATES HIGHWAY 377 AND RESIDENTIAL PROPERTIES, AND THE PURPOSE OF THIS PROVISION IS TO ENSURE THAT, DUE TO THE UNIQUE NATURE OF DATA CENTERS, THAT THE FOUR SIDED ARCHITECTURE REQUIREMENT FROM THE BUILDING QUALITY MANUAL, IT DOESN'T INHIBIT THE INHERENT NATURE OF THE OPERATIONS OF A DATA CENTER, AND THAT WE FOCUS THE DESIGN AND THE ESTHETICS ON THE SIZE OF THE STRUCTURE THAT WOULD BE MOST VISIBLE FROM RESIDENTIAL PROPERTIES THAT ARE IN COLOR TO THE SOUTH, AND ON THE KEY CORRIDOR THAT ACTS AS A KEY GATEWAY INTO WESTLAKE UNITED STATES HIGHWAY 377. THEN, IN TERMS OF THE UTILITY SHOP AND STORAGE WAREHOUSE STORAGE INSIDE AND OUTSIDE THAT THOSE BE PERMITTED AS ACCESSORY USES TO A MOVIE STUDIO THAT THE PROVISION BE ADDED INTO THE TEXT OF PD THREE EIGHT THAT WOULD EXEMPT MOVIE STUDIOS FROM THE BUILDING QUALITY MANUAL, AND THAT WOULD BE SUBJECT TO REVIEW OF THE TOWN PLANNER. AND DO NOTE THAT AS PART OF THIS EXERCISE, THAT DETAILED SITE PLAN IS STILL REQUIRED, AS IS A DEVELOPMENT AGREEMENT. BOTH OF THOSE WILL STILL NEED TO COME BEFORE THE TOWN COUNCIL AND EVEN WITH BEING SUBJECT TO REVIEW AND APPROVAL OF THE TOWN PLANNER FOR ANY MOVIE STUDIO THAT DECIDE TO COME INTO THE COMMUNITY, THAT WILL STILL NEED TO COME TO THIS BODY FOR FINAL APPROVAL. AND THEN THE FINAL THREE ITEMS JUST DEAL WITH SOME MINOR ADJUSTMENTS TO TEXT AND THAT SECTION NINE BE TITLED BUFFER REQUIREMENTS. SECTION NINE ONE BE ENTITLED NON-COMPATIBLE USE SETBACK. IN SECTION NINE TWO BE ENTITLED LANDSCAPE BUFFER. THE ACTIONS THAT ARE AVAILABLE TO THE TOWN COUNCIL ARE AS FOLLOWS. MOTION TO APPROVE. MOTION TO AMEND WITH THE FOLLOWING STIPULATIONS AND THOSE BE INCLUDED IN THE MOTION. THE MOTION TO TABLE AND THE MOTION TO DENY. I WILL PAUSE THERE. MAYOR. TOWN COUNCIL. I DO BELIEVE THE APPLICANT IS HERE AND MAY HAVE SOME WORDS I AS LONG AS THE APPLICANT ARE AVAILABLE FOR ANY QUESTIONS YOU MAY HAVE. ANY QUESTIONS FROM COUNCIL? EXCELLENT. I THINK WE'RE ALL BRIEFED ON THIS, SO THANK YOU. I NOW OPEN UP TO A PUBLIC HEARING IF THERE ARE ANY WISHES TO SPEAK. I WILL NOW CLOSE THE PUBLIC HEARING. CAN I GET A MOTION TO ADOPT ORDINANCE 1015? SO MOVED. CAN I GET A SECOND? SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? WELL DONE. THANK YOU ALL. ORDINANCE PASSES. REGULAR AGENDA ITEMS. [G.1. Discuss, consider and act on a request from Pearson 35 Opportunities, LLC to deviate from the required first floor square footage in Westlake Ranch by removing that provision and allowing the building setbacks to govern.] ORDINANCE 1016. [00:25:01] DISCUSS. CONSIDER AN ACT REQUEST FROM PEARSON 35 OPPORTUNITIES, LLC TO DEVIATE FROM THE REQUIRED FIRST FLOOR SQUARE FOOTAGE IN WESTLAKE RANCH BY REMOVING THAT PROVISION, ALLOWING THE BUILDING SETBACKS TO GOVERN. THANK YOU. MAYOR. TOWN COUNCIL. THIS IS A REQUEST TO REMOVE A PROVISION WITHIN THE PD FOR THE WESTLAKE RANCH DEVELOPMENT, DEALING WITH THE BUILDING SETBACK REQUIREMENTS, AS WELL AS A MAXIMUM REQUIREMENT ON THE FIRST FLOOR OF 7800FT². JUST TO PROVIDE A LITTLE BIT OF OVERVIEW FOR THIS CASE. ON MAY 24TH, 2021, THE TOWN COUNCIL APPROVED ORDINANCE NUMBER 928, WHICH ESTABLISHED RULES AND REGULATIONS FOR A PD PLANNED DEVELOPMENT DISTRICT FOR WESTLAKE RANCH. THOSE SAME RULES AND REGULATIONS FOR WESTLAKE RANCH INCLUDED THE PROVISION THAT UP TO 32 DETACHED SINGLE FAMILY RESIDENCES MAY BE DESIGNED AND CONSTRUCTED. HERE IS AN APPROVED PLAT, GENERALLY SHOWING THE LAYOUT OF WESTLAKE RANCH. YOU CAN SEE THE VARIETY OF LOT TYPES, AS WELL AS THE GENERAL LOCATION AND AREA OF THE DEVELOPMENT. JUST SOME PHOTOGRAPHS GENERALLY SHOWING THE DEVELOPMENT OF WESTLAKE RANCH. AND ONE OF THE RULES AND REGULATIONS THAT THIS PARTICULAR REQUEST IS HONING IN ON IS A LIMITATION THAT THE FIRST FLOOR SQUARE FOOTAGE BE LIMITED TO A MAXIMUM OF 7800FT². FROM A MARKET STANDPOINT, AND EVEN FROM AN ARCHITECTURAL STANDPOINT, THIS DOES INHIBIT THE ABILITY OF THE BUILDER TO RESPOND TO SHIFTS IN MARKET DEMAND AND PREFERENCE. AND WHILE THAT ISN'T A BASIS NECESSARILY FOR LAND DEVELOPMENT IN TERMS OF LAND DEVELOPMENT, THERE IS THE INHIBITION OF ARCHITECTURAL CREATIVITY AND INNOVATION THAT IS CAUSED BY THIS. AND BECAUSE OF THE FACT THAT THE PD DOES CONTAIN STANDARDS FOR ARCHITECTURAL DESIGN. THIS DOES RESTRICT FREEDOM OF ARCHITECTS AND BUILDERS TO DESIGN IN A WAY THAT IS NOT ONLY CONSISTENT WITH WESTLAKE URBAN FABRIC, BUT ALSO IN A WAY THAT PROMOTES EXCELLENCE IN ARCHITECTURAL DESIGN. JASON, WHAT WAS THE WHAT WAS THE REASON? WHAT WAS THE ORIGIN FOR THAT REQUIREMENT WHEN IT WAS FIRST PUT IN? THE ORIGIN FOR THAT REQUIREMENT, SIR, WAS REALLY TO PROMOTE MORE ARTICULATION AND MODULATION AND ENSURE THAT THERE WASN'T REPETITIVENESS IN ARCHITECTURAL DESIGN. AND THAT TO YOUR QUESTION, COUNCIL MEMBER YAKIRA IS WHY THERE IS THE PROPOSAL THAT INSTEAD OF THE LANGUAGE AS PROPOSED BY THE BUILDER, WITH LIMITING THE LOT COVERAGE ON THE FIRST FLOOR, THERE'S A DESIRE TO ELIMINATE SECTION TWO I IN ITS ENTIRETY, AND THEN THAT WOULD ALLOW THE BUILDING SETBACKS AS WELL AS THE MINIMUM UNIT SIZE TO GOVERN AND ENSURE THAT A THEY'RE MEETING THE REQUIREMENTS OF THE PD PLANNED DEVELOPMENT DISTRICT FOR WESTLAKE RANCH, AND B THAT THE ARCHITECTS AND BUILDERS THEY HAVE THE FREEDOM IN ARCHITECTURAL DESIGN AND EXPRESSION NEEDED TO RESPOND TO SHIFTS IN MARKET DEMAND. THIS ITEM WAS BROUGHT FORWARD TO THE PLANNING AND ZONING COMMISSION ON DECEMBER 10TH, 2024, AND THEY RECOMMENDED BY A VOTE OF 6 TO 0 WITH ONE ABSENCE, THAT SECTION TWO I BE REMOVED ENTIRELY FROM THE PLANNED DEVELOPMENT. TEXT. THE ACTIONS OPTIONS AVAILABLE TO TOWN COUNCIL ARE BEFORE YOU. MOTION TO APPROVE. MOTION TO AMEND WITH STIPULATIONS. MOTION TO TABLE AND MOTION TO DENY. AND WITH THAT MAYOR TOWN COUNCIL. I'LL PAUSE HERE TO ANSWER ANY QUESTIONS YOU HAVE. I DO BELIEVE THE APPLICANT IS ALSO AVAILABLE FOR QUESTIONS IF YOU HAVE THEM. I MEAN, THIS IS PRETTY STRAIGHTFORWARD. ANY QUESTIONS? JUST TO CLARIFY, FOR ANY RESIDENTS WHO MIGHT BE WATCHING. SO THE REQUEST IS TO LIMIT THE SIZE TO 40% OF THE LOT. AND THAT ALSO DOES NOT ACCOUNT FOR THE SETBACK. SO THE SETBACKS WOULD STILL BE IN PLACE. PLUS BEYOND THAT THEN 40% MAXIMUM LOT COVERAGE. YES, MA'AM. ANY OTHER QUESTIONS? CAN I GET A MOTION TO APPROVE ORDINANCE 1016? SO MOVED. CAN I GET A SECOND? SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? MOTION PASSES. MR. ROSE. APPRECIATE YOUR PATIENCE GOING THROUGH THIS. THANK YOU ALL. 20 5-13. [G.2. Discuss, consider and act on a request from Fox Brothers Holdings, LLC to deviate from permitted roofing materials in Entrada for a site known as Entrada Block M1, also known as La Cima de Entrada, which contains 18 townhomes generally located on the southeast corner of Girona Drive and Arta Drive.] DISCUSS, CONSIDER, AND ACT ON A REQUEST FROM FOX BROTHERS HOLDING, LLC TO DEVIATE FROM PERMITTED ROOFING MATERIALS IN ENTRADA FOR A SITE KNOWN AS ENTRADA [00:30:02] BLOCK M-1, ALSO KNOWN AS LA CIMA DE ENTRADA, WHICH CONTAINS 18 TOWNHOMES GENERALLY LOCATED IN THE SOUTHEAST CORNER OF VERONA DRIVE AND ARTA DRIVE. THANK YOU, MAYOR ALEXANDER. SO THE ARCHITECTURAL STANDARDS AND URBAN DESIGN CONSIDERATIONS THAT ARE CONTAINED WITHIN THE ENTRADA DESIGN GUIDELINES, THEY ARE INTENDED TO REPLICATE THE DISTINCT URBAN PATTERNS THAT ARE TYPICALLY FOUND IN VILLAGES IN SPAIN AND IN OTHER EUROPEAN NATIONS ALONG THE MEDITERRANEAN SEA. THE ARCHITECTURAL STANDARDS ARE AT TIMES VERY DETERMINISTIC, AND THAT IS INTENDED TO REPLICATE THAT ESTHETIC AND TO REPEAT THAT TYPE OF URBAN FABRIC AND THE DEVIATION REQUEST THAT IS IN FRONT OF YOU AS A BODY THIS EVENING IS FOR A SPECIFIC PROJECT WITHIN ENTRADA. AND JUST TO PROVIDE SOME PHOTOS OF THE CURRENT ROOFING STANDARDS AND STYLES THAT ARE IN ENTRADA. AND THE DEVIATION FROM THESE ENTRADA DESIGN GUIDELINES THAT ARE SUBJECT TO REVIEW AND RECOMMENDATION FROM THE PLANNING AND ZONING COMMISSION, AND APPROVAL BY TOWN COUNCIL, THE PLANNING AND ZONING COMMISSION. THEY MET ON DECEMBER 10TH, 2024, AND THEY DID RECOMMEND APPROVAL OF THE DEVIATION REQUEST BY A VOTE OF 6 TO 0 WITH ONE ABSENCE. I DO BELIEVE THE APPLICANT IS HERE AND DOES HAVE A PRESENTATION. IF I MAY PAUSE HERE AND YIELD THE PODIUM TO THE APPLICANT. MAYOR, TOWN COUNCIL? CERTAINLY. THANK YOU. MAYOR. COUNCIL. HOW'S EVERYBODY TODAY? EXCELLENT. GOOD. MY NAME IS GREG FOX. I'M ONE OF THE FOX, ONE OF THE FOXES OF FOX BROTHERS HOLDINGS. SO BG FOX, FOX BROTHERS, WE'RE THE ONES BUILDING THE 18 TOWNHOMES. WE'RE ALSO RESPONSIBLE IN PART FOR THE ORIGINAL TOWNHOMES AS WELL AT BLOCK I IN THERE ENTRADAS . AND IT IS ALSO SO WE HAVE QUITE A BIT OF EXPERIENCE IN THE NEIGHBORHOOD REGARDING SOME OF THE PAST ISSUES WE'VE HAD ON PREVIOUS BUILDINGS, AND SO WE'RE TRYING TO FIND KIND OF A BETTER MOUSETRAP FOR OUR RESIDENTS, AS WELL AS FOR THE FUTURE OF ENTRADA AND THE BUILDING MATERIALS IN GENERAL, WHICH IS WHY I'M SITTING BEFORE YOU TODAY. AND OH, AND THANK YOU, JASON, BY THE WAY. SORRY ABOUT THAT. SO WHAT WE'RE PROPOSING AND WHAT WE BROUGHT TO P&Z IS A CONCRETE REPLICA OF THE CLAY TILE. IT'S A VERY, VERY CLOSE LOOK ALIKE. IT'S A LOT MORE DURABLE. INSURANCE COMPANIES LIKE IT A LOT BETTER. YOU CAN WALK ON IT, YOU CAN WORK ON IT. AND AGAIN, WITH THE WEATHER THAT WE HAVE IN TEXAS. WHAT I SAID TO, TO PNC WE WERE LAUGHING ABOUT IS BECAUSE IT IS FANTASTIC FOR CATALONIA, SPAIN, BUT THEY DON'T HAVE SOFTBALL SIZED HAILSTONES IN SPAIN. AND UNFORTUNATELY, A LOT OF OUR RESIDENTS, ONE OF THE P&Z MEMBERS WHO LIVES IN ONE OF OUR TOWNHOMES, A BLACK I WAS ABLE TO SPEAK TO IT. HE'S HAD TO DEAL WITH QUITE A BIT OF THE DAMAGE THAT ONE OF THE LAST TOWNHOMES HAD TO HIS ROOF, AND WE ACTUALLY DO HAVE. AND SO WHAT MY ROOFER, THE GENERAL CONTRACTOR OF MY ROOFING COMPANY WHO HAS BROUGHT A COUPLE SAMPLES FOR YOU BEFORE I GET INTO THIS, I DO WANT TO GO AHEAD AND SHOW YOU. SO THOSE ARE THE DIFFERENCE OF THE TWO TILES. ONE'S CONCRETE, ONE'S CLAY. RIGHT. AND SO FROM THIS DISTANCE, WHICH IS A LOT CLOSER THAN WHEN YOU'RE LOOKING UP 30FT UP ON A ROOF, THAT'S GOING TO BE WHAT YOU'RE NOTICING A LITTLE DIFFERENCE. THE ONE ON THE LEFT. NOPE. IS CONCRETE. YEP. EXACTLY. YEAH, EXACTLY. YOU SOUND LIKE ME IN VEGAS. SO. YEAH. SO. YES, SIR. SO THAT IS THE DIFFERENCE BETWEEN THE TWO. AND YOU'RE ONLY LOOKING FROM A PARALLEL VIEWPOINT, NOT AN EXTREME THREE STORY VIEWPOINT LIKE OUR TOWNHOMES ARE GOING TO BE. AND SO IF YOU GO LOOK AT BLOCK I, WHAT YOU'RE LOOKING AT FROM THE GROUND UP, YOU'RE PRETTY MUCH ONLY GOING TO BE ABLE TO SEE THE EDGE OF THE TILE TO BEGIN WITH. AND, AND THE REASON BEING IS ENTRADA MEANS THE PEAK OF ENTRADA, BECAUSE OUR UNIT 12 ON THE CORNER IS GOING TO BASICALLY BE THE PEAK OF ENTRADA AND ONE OF THE HIGHEST POINTS THERE IS. SO NO ONE WILL BE LOOKING DOWN ON THE ROOF. EVERYONE WILL ONLY BE LOOKING UP AS THEY DRIVE IN AND DRIVE THROUGH. SO AERIAL VIEWS ARE PRETTY MUCH WHAT YOU'RE GOING TO SEE. SO ON THE PRESENTATION UP HERE. SO SOME OF THE EXISTING CLAY TILE DAMAGE THAT MY ROOFER WAS ABLE TO TAKE A DRONE, SOME DRONE FOOTAGES. SO THIS IS IN ENTRADA. AND THESE ARE SOME OF THE BUILDINGS IN ENTRADA THAT ARE THIS WAS JUST WAS THIS GIANNI. I'LL HAND IT OVER TO GIANNI BECAUSE IF YOU DON'T MIND COUNCIL. THANK YOU. FRIDAY OF LAST WEEK, I TOOK MY DRONE AND FLEW BASICALLY THE MAIN BUILDING, STARBUCKS. AND AROUND THERE. AND SO I, WITH THE DRONE, WE WERE ABLE TO SEE ALSO THE THERMAL VARIANTS. EASY TO SEE HOW MANY MORE TILES ARE BROKEN THAN YOU CAN ACTUALLY SEE WHEN YOU LOOK AT THE THERMAL CAMERA, BECAUSE YOU CAN SEE THE VARIATIONS. [00:35:08] ONE OF THE BIGGEST CONCERNS WE HAVE IN ANY ROOFING ENDEAVOR IS, IS WIND UPLIFT. IT'S ALWAYS THE MOST SEVERE THE HIGHER UP AND ON THE EDGES OF ANY BUILDING. SO YOU'LL NOTICE THE DISPLACEMENT. THERE'S ACTUALLY AN ENTIRE COVER ON THE EDGE OF THAT BUILDING THAT'S MISSING THERE. AND JUST SOME POINTING OUT THERE OF THE VARIOUS TILES THAT ARE DISPLACED AND REPAIR OR REPLACEMENT ADDITIONAL MISSING TILE, CAP LINE. AND THIS WAS OF THE MOST CONCERN BEING THAT LASEMA WILL BE SO HIGH UP. THIS IS THE HIGHEST BUILDING OF THAT PARTICULAR SECTION, AND YOU CAN SEE HOW MUCH DAMAGE THERE IS. SO AND THESE ARE NEW PHOTOS. THESE WERE JUST TAKEN THREE DAYS AGO. ONE OF THE THINGS ABOUT THE CONCRETE TILE IS ITS WEIGHT. HERE'S A COUPLE PICTURES I PUT TOGETHER FOR YOU. ON THE LEFT. ON THE SCREEN. THE LEFT. THE LEFT UP TOP IS THE IS THE CLAY TILE, AND THE RIGHT IS THE CONCRETE SHOWN KIND OF AT A CLOSER LOOK. AND THEN A DISTANT VIEW. AND THIS IS THE CONCRETE SP TILE THAT WE'RE DISCUSSING THAT IS SHOWN OVER HERE. FROM AN AERIAL VIEW ON ANOTHER PROJECT. AND THEN HERE'S WHAT REALLY IS THE MOST SUBSTANTIAL CHANGE FOR THE BENEFIT OF THE PROPERTY OWNER, WHICH WOULD BE THE WEIGHT OF THE TILE. SO IF YOU FACTOR IN THE SQUARE FOOTAGE AGAINST THE WEIGHT, YOU'RE ALMOST DOUBLE ON THE WEIGHT OF THAT CONCRETE DOESN'T REALLY AFFECT ANYTHING IN TERMS OF THE STRUCTURE OF THE BUILDING OTHER THAN THE TRUSS SPACINGS OR. BUT IT'S A MUCH HEAVIER DUTY MATERIAL, REALLY WITHSTANDS THE WEATHER AND THE HAIL MUCH BETTER, AND A BETTER OPTION. CAN I ASK YOU A QUESTION? I NOTICED THAT LIKE NOW THE REQUIREMENTS ARE THE TWO PIECE MISSION TILE. DID YOU GUYS CONSIDER DOING THE OR PROPOSING TO DO THE ONE PIECE CLAY S TILE VERSUS GOING STRAIGHT TO TILE? NO, WE NEVER BECAUSE THAT DOESN'T SOLVE THE PROBLEM THAT WE'RE TRYING TO WE ACTUALLY THAT WE BROUGHT THAT UP TO EACH OTHER. LIKE WHAT IF WE JUST DO A VARIANCE IN THE ACTUAL INSTEAD OF THE TWO PIECE? COULD THE ONE PIECE BE A LITTLE BIT MORE DURABLE? BECAUSE THAT TWO PIECE OVERLAY IS DEFINITELY NOT AS DURABLE, BUT IT'S STILL NOT NEAR AS DURABLE AS WHAT THE CONCRETE IS. AND SO THE DECISION WAS BASICALLY, NOW WE NEED TO JUST GO WITH THE CONCRETE AFTER SEEING, YOU KNOW, IMAGES LIKE THIS, WE DECIDED, NO, I THINK I ASK YOU THIS, I APOLOGIZE IF I DID. IS THERE AN INSURANCE BREAK FOR PEOPLE THAT HAVE THESE ROOFS? I ACTUALLY ASKED JOSH HOUSE INSURANCE COMPANY WITH ALLSTATE AND TROPHY CLUB. I ASKED HIM THAT. HE SAID IT DEPENDS ON YOUR POLICY. YES, THERE IS GOING TO BE BECAUSE OF ITS HAIL RATING THAT HE WOULD GET. ALLSTATE DOES DO A BETTER INSURANCE BREAK ON IT. YEAH, RIGHT. SAME WITH METAL ROOFS. WELL, AND I KNOW THAT THE WESTLAKE S TILE ALSO HAS AN HAS CLASS THREE HAIL RATING. AND IT DOES HAVE AN INSURANCE RATE TOO. BUT THE MISSION I DO NOT BELIEVE AT ALL. YEP. YEAH. SO THERE'S A FINANCIAL BENEFIT TO THE RESIDENTS AS WELL. EXACTLY TO YOUR POINT. AND LIKE I SAID MR. RICHIE ON P&Z, WHO, YOU KNOW, WE HAD THAT DISCUSSION AS WELL. HE'S LIKE, I HAVE A QUICK QUESTION. YES, SIR. THE I NOTICED THE WIDTH OF THE TWO IS DIFFERENT. WILL IT ESTHETICALLY BE DIFFERENT AS FAR AS THE NUMBER OF TILES YOU'RE GOING TO HAVE ON A ROOF? SO IT SOUNDS LIKE IT'S GOING TO BE. IT'LL BE A SLIGHT BIT ESTHETICALLY DIFFERENT TO A CLOSE UP VIEW. YEAH. IT'LL BE 30FT UP IN THE AIR. AND I'LL ACTUALLY I'LL BE CLEAR ON ONE THING I WILL AGREE WITH ON THE ESTHETIC APPEARANCE. IF I WAS DOING A SINGLE FAMILY HOME WITH A TEN FOOT PITCH, IT MIGHT BE A LITTLE BIT DIFFERENT. I ACTUALLY PROBABLY WOULDN'T BE ASKING YOU TO TRY TO KEEP. BUT BECAUSE OF THE HEIGHT OF THIS, WHEN YOU LOOK UP AT THE VERY. YOU WON'T BE ABLE TO NOTICE A DIFFERENCE. WELL. AND ADDITIONALLY. RIGHT. I MEAN, IT'S GOING TO BE SO MUCH MORE DIFFICULT TO GET UP ONTO THAT ROOF IF WHEN YOU HAVE A GREAT POINT. ANOTHER ISSUE IS THEY CANNOT DO IT ELSE THAT MATCH THE SAME LOT COLOR. SO YOU END UP WITH ROOFS THAT LOOK SPECKLED AND YOU'RE TRYING TO MAKE IT LOOK UNIFORM AND IT CAN'T LOOK UNIFORM ONCE YOU REPAIR IT. THREE TILES ALL THE SAME, BUT THEY DON'T BREAK WITH THE HAIL. IT WILL LOOK BETTER IN LONG TERM CARE. CORRECT. IN TERMS OF LONG LASTING APPEARANCE, ALL DRIVEN BY SHINGLE HOUSES WHERE YOU CAN PATCH. BUT THE REALLY OTHER CRUCIAL ISSUE FOR THE BUILDER IN THIS CASE IS THE CLAY ISN'T AVAILABLE FOR 3 TO 4 MONTHS. THAT'S. SO, YOU KNOW, YOU'RE TALKING ABOUT DELAYING CONSTRUCTION AND COSTS. AND IT'S A PRETTY SIGNIFICANT ISSUE. WE SPOKE TO THAT EXACT ISSUE ABOUT. HE SPOKE ABOUT IT TO P&Z IS THAT THAT IS A BIG IT'S A BIG DEAL BECAUSE THE OVERTIME WEATHERING CLAY TILE FADES A LOT. [00:40:05] AND IT IS IT IS NOT A REPRODUCIBLE PRODUCT LIKE A CONCRETE TILE IS. YEAH. CORRECT. AND HAVING TO REPLACE A ROOF I KNOW EXACTLY WHAT YOU'RE TALKING ABOUT. AND WITH THIS YOU COULD PATCH IF YOU ACTUALLY NEED TO. BUT THE WHOLE GOAL IS YOU NEVER WILL HAVE TO PATCH BECAUSE THE DURABILITY. ANY OTHER QUESTIONS FROM COUNCIL? PERFECT. I'VE HAD A TILE ROOF. YEAH. LET ME. LET'S TAKE A VOTE THEN. I GOT A COMMENT. CAN I GET A MOTION TO PASS ORDINANCE OR DENIED TO 513? SO MOVED. CAN I GET A SECOND? ALL IN FAVOR? AYE. ANY OPPOSED? MOTION PASSES. MR. FOX, THANK YOU. TO COUNCIL, I JUST, I WANT TO THANK YOU ALL. AND TO ADAM AND PLANNING AND ZONING. YOU KNOW, I FELT LIKE THERE'S A REASON ENTRADA HAS BEEN SITTING FOR A LOT OF YEARS, AND IT WAS. WE WERE DIFFICULT. WE KNOW ALL OF THOSE STORIES, AND I JUST. I REALLY APPRECIATE YOU ALL, INCLUDING PLANNING AND ZONING, OPEN OF NEW WAYS AND NEW TECHNOLOGIES OR NEW CONSTRUCTION MATERIALS THAT WILL CONTINUE TO GET THIS DEVELOPMENT GOING FOR US. SO I THANK YOU ALL FOR THAT. YES, SIR. THANK YOU VERY MUCH FOR YOUR TIME. I ACTUALLY WANT TO REITERATE THAT BECAUSE I'VE BEEN INVOLVED IN ENTRADA FOR OVER A DECADE NOW AND HAVE BEEN THROUGH MULTIPLE REGIMES OF CITY COUNCIL AND P AND Z. SO I DO WANT TO THANK EVERYONE HERE, INCLUDING THE P&Z. JASON HAS BEEN FANTASTIC TO WORK WITH. SO IS WADE BECAUSE AS SOMEONE WHO DOES BUSINESS IN ENTRADA, IT HAS BEEN VERY DIFFICULT FOR YEARS. QUITE A FEW YEARS AGO, TO BE VERY FRANK. SO I JUST WANT TO THANK EVERYBODY HERE FOR, FOR, FOR WHAT YOU ALL ARE DOING FOR THE TOWN. THANK YOU. THANK YOU FOR YOUR PATIENCE AND. AND SPREAD THE WORD. YES. THANK YOU. THANKS, GREG. THANKS, Y'ALL. THANK YOU ALL VERY MUCH. ALL RIGHT. RESOLUTION 2503. [G.3. SO THIS IS ON ME. SO WHAT I WOULD LIKE TO ASK COUNCIL TONIGHT IS WE INITIALLY APPROVED $500,000. IT'S IN YOUR PACKET FOR WHAT WE WANTED TO DO. KIND OF THE OPTION THREE I THINK WE'RE $236,688 OFF. WE HAVE $1.1 MILLION FOR ATHLETIC FACILITIES IN OUR TOWN. WHAT I'D LIKE TO GET IS AN APPROVAL TO MOVE OUR CONTRIBUTION UP TO 1 MILLION, AND THEN NO FURTHER MOVEMENT UNTIL WE HAVE SECURED THE ADDITIONAL 276,688. SO ARE YOU SAYING WE'RE NOT SIGNING A LETTER TODAY? WE ARE. I AGREE WITH THAT. AND I'LL WAIT. BUT I WANT TO GET TO. AND I SHOULD HAVE ASKED FOR IT FIRST. AND I THINK I HAD A LOT OF INDIVIDUAL CONVERSATIONS HOW THIS ALL TRANSPIRED. I FEEL VERY GOOD. WE'RE GOING TO GET THIS DONE, BUT WE'RE GOING TO BE A LITTLE MORE FORMAL AND FOLLOWING PROCEDURES. AND THE GUYS HAVE ALL RIGHTFULLY ASKED TO DO. SO I WOULD LOVE TO GET A MOTION FOR 25-03 TO RAISE IT TO $1 MILLION WITH NO FURTHER ACTION TAKEN. UNTIL WE SECURE THE ADDITIONAL $276,000. SOUNDS GOOD. SO MOVED. CAN I GET A SECOND? SECOND. ALL IN FAVOR? AYE. ANY OPPOSED? THANK YOU ALL VERY MUCH. MOTION CARRIES. ORDINANCE 1017. [G.4.
