A TOWN OF WESTLAKE PROCLAMATION, RECOGNIZING DR. MATTHEW EVANS AND OFFICER PHILLIP DAVIS FOR ACTIONS TAKEN, SAVING THE LIFE OF ANOTHER.
WHEREAS ON FEBRUARY 1, 2025, DURING A 50 MILE BIKE RIDE, MR. BILL PARMLY SUFFERED A SUDDEN HEART ATTACK ON OTAGER ROAD IN THE TOWN OF WESTLAKE.
DR. EVANS, WHO WAS DRIVING RIGHT BY HIM, WITNESSED THE COLLAPSE AND IMMEDIATELY STOPPED HIS CAR TO ASSESS MR. PARMLY.
DR. EVANS, SELFISHLY, WITHOUT REGARD TO HIS OWN PERSONAL SAFETY, MADE A QUICK DECISION TO RENDER AID, CALLING 911 TO BEGIN PERFORMING CPR.
THEN OFFICER DAVIS ARRIVED WITH AN AED, AND WORKING TOGETHER, THEY APPLIED THE DEFIBATOR PADS.
AFTER SUCCESSFUL DEFIBRILLATION, CPR CONTINUED UNTIL WESTLAKE FIRE EMS, CAPTAIN T VILLANES, FIREFIGHTER MACADO, FIREFIGHTER, PARAMEDIC CARTER, AND FIREFIGHTER THURSTON ARRIVED TO TOOK OVER CARE PREPARING MR. PARMLY FOR TRANSPORT TO THE HOSPITAL.
DR. EVANS AND OFFICER PHILLIPS WHILE PLACING THEMSELVES IN IMMINENT DANGER, PERFORMING A PURPOSEFUL, DISTINCTIVE AND SUCCESSFUL LIFESAVING ACT ON ANOTHER HUMAN BEING.

PROTECTIVE PULSE AND HE HAD ONE INITIALLY, BUT HE QUICKLY LOST IT.
I WAS SURREAL TO THINK, THIS IS HAPPENING. WE'RE GOING TO DO THIS.
BUT EVEN FROM SOMEONE LIKE MYSELF WHO'S DONE THIS COUNTLESS TIMES TO BREAK THAT ICE OF WE'RE GOING TO TAKE THE NEXT STEP AND INTERVENE WAS SOMETHING THAT FELT ODD AND UNCANNY.
I THINK BILL IS OF SIMILAR MINDSET THAT WE REALLY TRIED TO USE THIS TO HELP GET OUT THE WORD THAT IT'S ACTUALLY PRETTY SIMPLE TO DO THIS.
YOU JUST HAVE TO BE WILLING TO STEP IN AND HANDLE IT.

WHENEVER OFFICER DAVIS CAME RUNNING TOWARD ME, I YELLED OUT, DO YOU HAVE AN AED? CAN YOU GO GET IT? HE IMMEDIATELY ABOUT FACED, WENT AND GOT IT, KNEW HOW TO APPLY IT, KNEW WHAT HE WAS DOING, TRAINING KICKED IN AND WAS FLAWLESS.
I'LL SAY THE SAME WITH THE FIREFIGHTERS AND THE EMS PERSONNEL THAT ARRIVED AS WELL.
WE RAN THE CODE LIKE IT WOULD BE RUN IN THE MIDDLE OF THE HOSPITAL.
THAT'S AN ATTESTMENT THAT IS BILL'S OUTSTANDING PERFORMANCE ON THE BIKE TO THIS DAY.
HE WAS IN IF IT HAD HAPPENED IN THE WEEK, HE WOULDN'T HAVE BEEN IN THE HOSPITAL MORE THAN 48 HOURS.

AS MR. SASSER MENTIONED EARLIER THIS AFTERNOON, THERE IS A RIBBON CUTTING CEREMONY THAT WILL BE HELD ON MARCH 27.

AS A RAPIDLY GROWING COMMUNITY, THE TOWN OF WESTLAKE HAS AN OPPORTUNITY TO CONSIDER THE IMPLEMENTATION OF WATER, WASTEWATER, AND/OR ROADWAY IMPACT FEES THAT WILL ALLOW FOR DEVELOPMENT TO PARTICIPATE IN THE COSTS OF NECESSARY FUTURE IMPROVEMENTS TO SERVE THE COMMUNITY.
NEW DEVELOPMENT CAN SIGNIFICANTLY INCREASE TRAFFIC ON ROADWAYS, WATER CONSUMPTION, AND WASTEWATER VOLUMES.
IMPACT FEES ARE A ONE-TIME CHARGE ASSESSED TO NEW DEVELOPMENT AND REDEVELOPMENT CALCULATED IN ACCORDANCE WITH THE METHODOLOGY OUTLINED IN CHAPTER 395 OF THE TEXAS LOCAL GOVERNMENT CODE.
THE FEES ARE BASED ON LAND USE ASSUMPTIONS, EXPECTED POPULATION GROWTH, AND CORRESPONDING CAPITAL IMPROVEMENTS AND EXPENDITURES NECESSARY TO SUPPORT THAT GROWTH.
THAT BRINGS US TO THE ITEM ON THIS EVENING'S AGENDA: THE APPOINTMENT OF THE CAPITAL IMPROVEMENTS ADVISORY COMMITTEE AS REQUIRED BY CHAPTER 395 OF THE TEXAS LOCAL GOVERNMENT CODE.
THE COMMITTEE PLAYS AN IMPORTANT ROLE IN THE IMPACT FEE PROCESS AS THEY PROVIDE

OUR CONSULTANT DID PROVIDE A PRESENTATION TO THE P&Z AT THEIR MARCH 11 MEETING WHERE THEY WERE GIVEN THE OPPORTUNITY TO ASK QUESTIONS ABOUT THEIR RESPONSIBILITIES AS A COMMITTEE.
THIS EVENING, WE HAVE ANDREW FRANCO WITH FREESE AND NICHOLS.
HE WILL BE PROVIDING A BRIEF STATUS UPDATE ON THE IMPACT B STUDY AND THE ROLE OF THE COMMITTEE.

CHERYL KIND OF HIGHLIGHTED AS WELL, THERE'S THAT EXTRA BURDEN PLACED ON OUR WATER SEWER, AND ROADWAY INFRASTRUCTURE SYSTEMS. BUT WHAT WE'RE TRYING TO DO IS DO A STUDY AND AN ASSESSMENT OF WHAT COULD A POTENTIAL FEE STRUCTURE LOOK LIKE IF THE TOWN WERE TO MOVE FORWARD WITH THIS PROCESS.
BY COMMISSIONING THE STUDY, BY APPOINTING THIS COMMITTEE, DOING ALL THESE THINGS THAT WE'RE DOING RIGHT NOW, WE HAVE MADE NO DECISIONS AT THIS POINT.
WE'LL BE COMING BACK TO YOU GUYS LATER THIS YEAR WITH NUMBERS, WITH INFORMATION.
THAT'S GOING TO FURTHER ALONG THE PROCESS, BUT ULTIMATELY ANY DECISION THAT'S MADE IS GOING TO BE MADE BY THE TOWN COUNCIL.
JUST WANT TO MAKE SURE THAT'S CLEAR FROM THE GET-GO THAT WE HAVEN'T PRODUCED ANY NUMBERS YET AND WE'RE NOT TO THAT POINT YET.
HERE WE ARE AT THE VERY EARLY STAGES OF THE PROJECT.
LIKE CHERYL SAID, WHO'S GOING TO HELP PAY FOR SOME OF THIS GROWTH? WE HAVE SALES TAXES HELP TO PAY FOR ROADWAY PROJECTS, YOUR WATER BILL HELPS PAY FOR PROJECTS RELATED TO YOUR WATER AND SEWER SYSTEMS. REALLY, WHAT THE IMPACT FEE PROGRAM IS, IS AN NEED ADDITIONAL FUNDING MECHANISM THAT CAN BE UTILIZED TO HELP PAY FOR GROWTH-RELATED IMPROVEMENTS.
AS WE GET INTO IT LATER ON IN THE STUDY, YOU'LL SEE WE'RE ONLY GOING TO IDENTIFY PROJECTS THAT HELP SERVE GROWTH.
WE'RE NOT GOING TO TALK ABOUT PROJECTS THAT DON'T SERVE NEW GROWTH, MAYBE SOME O&M OR SOME OTHER RECONSTRUCTION.
THE FEES THAT YOU COLLECT CANNOT BE USED FOR THOSE TYPES OF PROJECTS, THEY CAN ONLY BE USED ON GROWTH-RELATED PROJECTS.
BY HAVING THESE FEES IN PLACE, WE HELP SUPPLEMENT AND ESSENTIALLY SUBSIDIZE THE INFRASTRUCTURE NEEDED FOR PAYING FOR OUR GROWTH. THAT'S THE TAGLINE.
IT'S THE BELIEF THAT NEW DEVELOPMENT SHOULD PAY THEIR FAIR SHARE OF THE ADDITIONAL BURDEN THAT THEY DO PLACE ON THE INFRASTRUCTURE.
CHAPTER 395 OF THE TEXAS LOCAL GOVERNMENT CODE ARE THE STATUTES THAT WE ABIDE BY IN DOING THIS PROCESS.
THE METHODOLOGY IS LAID OUT AND WE WANT TO FOLLOW ALL THE PROPER RULES AND MAKE SURE THAT WE'RE DOING THE PROCEDURES AND HOLDING ALL OF THE DIFFERENT ADMINISTRATIVE COMPONENTS OF RUNNING THE PROGRAM.
IF YOU DO ENTER INTO A FEE PROGRAM, YOU WILL BE REQUIRED BY STATE LAW TO REVISIT AND UPDATE THE STUDY EVERY FIVE YEARS.
REALLY, WHAT THAT DOES IS TO MAKE SURE THAT THE FEES ARE COMPARABLE TO THE AMOUNT OF GROWTH THAT YOU'RE HAVING IN YOUR CITY.
IF YOU'RE GROWING A LOT MORE AND YOU HAVE A LOT MORE KNEES, YOU CAN RAISE YOUR FEES.
IF YOU'RE NOT GROWING AS MUCH, YOU CAN LOWER YOUR FEES BECAUSE THE DOLLARS AREN'T GOING TO BE THERE TO SUPPORT THE GROWTH-RELATED PROJECTS.

WE'VE REALLY STARTED DEVELOPING WHAT THE LAND USE ASSUMPTIONS LOOK LIKE.
BUT WHAT'S THE PROFILE OF THE DEMOGRAPHICS OVER THE NEXT 10, 20 YEARS HERE IN WESTLAKE? THOSE ARE THE COMPONENTS OF THE PROJECT THAT ARE ALREADY MOVING FORWARD, DEVELOPING THOSE CAPITAL IMPROVEMENT PLANS, THE IFCIP IMPACT FEE CAPITAL IMPROVEMENT PLAN.
WE'LL HAVE THREE DIFFERENT CIPS THERE FOR WATER, SEWER, AND THE ROADWAYS BEING GENERATED AND THE WASTEWATER ALSO IN THE WORKS AS WELL.
AFTER WE DO THAT, YOU'LL SEE ON THE SCHEDULE SLIDE HERE IN A MINUTE, WE WILL HAVE TWO PUBLIC HEARINGS AS PART OF THIS PROCESS.
FIRST PUBLIC HEARING WILL BE TO REVIEW AND ACCEPT THE LAND USE ASSUMPTIONS AND THE CAPITAL IMPROVEMENT PLANS.
FROM THERE, WE'LL GO BACK AND DO THE CALCULATIONS TO SEE WHAT THE FEE STRUCTURE COULD POTENTIALLY LOOK LIKE.
WE USUALLY START WITH WHAT'S THE MAXIMUM ALLOWABLE THAT THE STUDY ASSESSES? THEN WE DO SOME BENCHMARKING WITH SOME NEIGHBORING UTILITIES AND FIGURING OUT WHAT'S RIGHT FOR WESTLAKE.
THEN WE'LL COME BACK TO THAT SECOND PUBLIC HEARING.
DO WE WANT TO MOVE FORWARD AND ADOPT A PROGRAM OR NOT? BUT SKIPPED OVER THE BOX ABOUT THE CIAC, WHICH IS REALLY WHAT WE'RE HERE FOR TONIGHT.
STATE LAW DOES REQUIRE THAT THERE'S AN ADVISORY COMMITTEE THAT'S GOING TO PROVIDE REALLY INPUT AND RECOMMENDATION TO THE COUNCIL, DO THE TECHNICAL COMPONENTS OF THE STUDY, ARE THEY RIGHT FOR WESTLAKE, THAT'S GOING TO BE PART OF THE OVERALL PROCESS AS WE MOVE FORWARD.
TALK ABOUT PROVIDING COMMENT ON THE LAND USE ASSUMPTIONS, THE CAPITAL IMPROVEMENT PLANS, THE CALCULATIONS, AND THEN THEY WILL BE PROVIDING THOSE WRITTEN RECOMMENDATIONS TO COUNCIL AHEAD OF THOSE TWO PUBLIC HEARINGS.

THE STATE REQUIRES THAT STUDENTS HAVE 25,600 MINUTES OF STUDENT INSTRUCTIONAL TIME EVERY YEAR.
ANY MINUTE LOSS DUE TO AN EMERGENCY CLOSURE, WE ARE REQUIRED TO MAKE UP.
IN ADDITION, THERE'S 187 CONTRACT DAYS FOR TEACHERS.
WHEN WE BUILD THE CALENDARS WHEN WE PASSED THE CALENDAR LAST MONTH OR MONTH BEFORE LAST, WHAT HAPPENS THEN IS PEOPLE PLAN AROUND THOSE CALENDARS, THEY PLAN TO GO ON VACATION OR BE DONE OR A MYRIAD OF THINGS BECAUSE WE'RE GIVING THEM AN OUTLINE OF WHAT THEIR YEAR SHOULD LOOK LIKE, BUT THE STATE REQUIRES US TO THEN MAKE UP THAT TIME.

THE STORM, I GUESS, WAS THE LONGEST BREAK THAT MOST OF US SAW, AND ANYTHING BEYOND FIVE DAYS IN THE EVENT THAT ANYTHING LIKE THAT EVER HAPPENED, THEN WE COULD COME BACK TO THE BOARD AND THAT COULD BE ADDRESSED ON A CASE BY CASE BASIS.
IMPACT OF THIS IS THAT IT WOULD ALLOW ADMINISTRATION TO KNOW IN ADVANCE HOW WE CAN PROCEED IN THESE SITUATIONS INSTEAD OF HAVING TO WAIT UNTIL SOMETHING HAPPENS AND THEN AFTER THE FACT, THERE'S THIS FLURRY OF ACTIVITY WE DID IT THIS YEAR AS WE FIGURED OUT WHAT WE WERE GOING TO DO WITH REGARD TO THE STUDENTS MISSING THOSE DAYS, BUT THEN YOU ALSO HAVE TO FIGURE OUT WHAT'S GOING TO HAPPEN WITH THE TEACHERS AND THE SUPPORT STAFF AND ADMINISTRATORS.
IT JUST ENSURES THAT THESE PEOPLE THAT KEEP THE SCHOOL RUNNING ARE GOING TO GET PAID DESPITE AN EMERGENCY.
IT'S A TOUCH POINT FOR THEM TO SAY, HEY, WE UNDERSTAND THIS WASN'T YOUR FAULT.
YOU HAD NOTHING TO DO WITH IT, BUT THE SCHOOL COULDN'T BE OPEN.
IT PREVENTS US FROM HAVING TO EXTEND THE SCHOOL YEAR, WHICH IMPROVES MORALE, AS YOU CAN IMAGINE.
IT ALSO RECOGNIZES ALL OF THE WORK THAT WE KNOW OCCURS OFF CONTRACT HOURS FOR TEACHERS AND SUPPORT STAFF.
IT'S NOT SO MUCH ABOUT ADMINISTRATORS, BUT PARTICULARLY FOR THOSE PEOPLE, TO JUST ACKNOWLEDGE, WE KNOW YOU WORK BEYOND A 40 HOUR WEEK.
MAKE-UP TIME IS A LITTLE ARBITRARY IN EDUCATION BECAUSE MOST EVERYONE IS LOGGING LOTS MORE HOURS THAN WHAT IS TECHNICALLY REQUIRED.

OTHER THAN THAT, THERE ARE NO MATERIAL CHANGES.
I DO WANT TO SPECIFICALLY CALL OUT THAT AFTER THE AGENDA WAS PUBLISHED, WE WERE ABLE TO CONNECT WITH FIDELITY, WHO IS ONE OF OUR IN TOWN PARTNERS AS YOU KNOW, AND GET WITH THEM AND THEIR BRANCH THAT WORKS IN GOVERNMENT INVESTMENT.

THEN LASTLY, WE ASK THEM TO PROVIDE FINANCIAL STATEMENTS, THE RESUME, AND THE QUALIFICATIONS OF THOSE SPECIFIC INDIVIDUALS THAT WE WOULD BE DEALING WITH.
